What the inspector wrote

On June 23, 2022 at 11:30 AM, Licensing Program Analyst (LPA) Betzayra Cervantes conducted an announced visit for the purpose of conducting a Case Management - Other inspection to follow up on Action Level Exceedance (ALE) reported to the Regional Office by California State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW) . LPA met with Master Teacher Ambar Lopez and discussed the nature and purpose of the visit and a tour of the facility was conducted both inside and outside. LPA conducted COVID-19 risk assessment. All answers indicated no exposure to COVID-19. LPA observed a total of 16 children under the care and supervision of 5 staff members. The center is located on the premises of Rio del Norte Elementary School. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101704, which may include remediation. The Regional Office received an ALE for two (2) different water outlets in this facility. The Center was notified by LPA Michael Mathew of the results on May 27, 2022 by phone. The facility has taken the following steps as a Plan of Correction (POC) : Closed the affected water fixtures by taping it securely so no one can use it as well as a "do not use" sign on the fixtures. LPA observed that both outlets were taped off preventing use, and parents have been notified of test results. Classroom J127 is currently not being used. Children do not have access to the classroom and are using classroom J126 for hand washing only. LPA observed the testing report posted for parents and authorized representatives view at the facility entrance. Center has notified Rio School District facilities who replaced both fixtures to remediate. Continued on 809-C LPA provided a copy of Effects of Lead Exposure handout (PUB 515) and discussed the need for the Center to share this with families, discussed the plan of correction with the Master Teacher and informed her of the Plan of Correction for lead exceedances must include notification of parents and information about what has been done. However, center has replaced both water outlets as a corrective action and is currently in the process of conditioning the outlets to the water at the facility prior to resampling. Pursuant to section 101705 of the Written Directives, the newly replaced outlets must be flushed regularly (four times a day for at least 30 seconds) for at least three weeks prior to follow-up sampling. LPA observed the new fixture tracking sheet and labeled LIC 999 Facility Sketch. No deficiencies were cited during today's visit. Exit interview conducted and report was reviewed with Master Teacher, Ambar Lopez. THE NOTICE OF SITE VISIT WAS POSTED AS REQUIRED BY H&S CODE SEC. 1596.817. THE NOTICE OF SITE VISIT MUST REMAIN POSTED FOR 30 DAYS OR A CIVIL PENALTY OF $100.00 WILL APPLY.
