What the inspector wrote

THIS IS AN AMENDED REPORT On February 19, 2025 at 11:05 AM Licensing Program Analyst (LPA) Laura Carone conducted an unannounced inspection to complete a Case Management-Deficiencies visit. LPA met with licensee, Ana Victoria Shea and explained the purpose of the visit. LPA conducted a tour of the facility inside and outside with licensee. The home is divided into 3 units. The main house and 2 units over the garage. The entryways to the units are separate on opposite sides of the garage. LPA observed a total of 9 children under the care and supervision of 3 adults. Licensee's 2 dogs have current immunizations. As LPA was conducting a tour of the child care, deficiencies were observed and pictures were taken. In the playroom, LPA observed Vaporub, Lysol spray, and first aid antiseptic on a shelf less than 5 feet in height. LPA explained that the toxic items are accessible to the children in care. The children were in the backyard, so it was not an immediate threat. Toxic or hazardous items need to be kept out of reach of children in care. Licensee removed items and placed them in a high cabinet shelf inaccessible to children. A type B citation was issued Section 102417(g)(4): (g) Operation of a Family Child Care Home. LPA observed a small and shallow water fountain next to the front door. LPA asked Licensee how long the water fountain has been there. Licensee stated that it has been there for a long time. Licensee explained that the entrance for parents and children is through a side gate. Children do not have contact with the front door. LPA observed a body of water in the yard. The water was in a child sized plastic tub used for bathing. It was in an area that is gated with a small gate under 5 feet in height. LPA explained to licensee that any body of water fall under the Title 22 Regulations for bodies of water. Licensee informed LPA that it was water from the rain had accumulated which she uses to water plants. Licensee poured water out in presence of LPA. A type B citation was issued Section 102417(5)(A) Operation of a Family Child Care Home.LPA reviewed roster of associated adults to her child care license. S1 is listed as in process. LPA asked licensee whom the CONTINUED ON LIC809C individual is. Licensee stated that she is an assistant that came to provide care to the children on 01/17/2025 from 3:00PM to 5:00PM while she was out of the home. S2 and S1 were left to care for the children. LPA informed licensee that finger prints that are in process are not a clearance and the individual can not be in the child care home at any time. Licensee showed LPA a transfer request that she completed and submitted to the Department. LPA explained that a clearance letter is sent when an individual's fingerprints have been cleared. Only then can an adult be present in the child care home. A type A citation was issued section 102416(d)(2):(d) Personnel Requirements. During interview process, LPA asked licensee what area and on what children nap in. Licensee explained that C1 naps in a bedroom in a play pen and the other children nap on mats in the playroom. LPA asked Licensee what time children nap. Licensee stated that they nap from any time from 12:00PM or 12:15PM to about 2:30PM. LPA asked what if a child wakes up during those hours and doesn't want to continue napping. Licensee explained that they try to keep child quiet on the mat, so that the other children don't wake up. Licensee expressed to LPA that it is difficult when a child wakes up making noise and wakes up the other children. LPA asked if the child that is awake is offered an alternate activity. Licensee stated that they need to stay quiet on the mat. LPA explained that a child can not be forced to sleep or confined to an area. It is a violation of a child's personal rights. During inspection, LPA observed C1 in a swing in the back yard from 10:10AM to 11:05AM. LPA asked Licensee how long the child typically stays in the swing. Licensee stated that before they went outside he was in the playroom moving in the infant area. LPA explained that a child can not be restrained to a device for long periods of time. There were 2 assistants with 9 children in the yard. A type B citation was issued section 102425(e) Infant Safe Sleep. Notice of Site Visit (LIC9213) will be posted. The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. Appeal rights were given LIC9058. LPA Laura Carone informed licensee, Ana Victoria Shea that this report dated 02/19/2025 documents 1 Type A citation which shall be posted for 30 consecutive days as this is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Laura Carone informed the licensee to provide a copy of this licensing report dated 02/19/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Exit interview conducted with licensee, Ana Victoria Shea. The report was reviewed and a copy was given along with a copy of regulations cited.

This requirement was not met as evidenced by: When S1 worked at the facility on 01/17/25, the individual was not associated to the facility. Per Guardian the transfer was completed on 01/22/25. This is an immediate risk to the children in care.

  • 102417(5)(A)Type B

    102417 Operation of a Family Child Care Home-(5)(A) All licensees shall ensure the inaccessibility of...similar bodies of water through a pool cover or by surrounding the pool with a fence. Fences shall be at least five feet high...locked while the pool is not use. This requirement was not met as evidenced by: A child sized bath tub was in the yard filled with waiter on the other side of a short fence (not 5 feet). Licensee emptied in LPA's presence. This is a potential risk to children in care.

  • OPERATION OF A FAMILY CHILD CARE HOME

    102417 Operation of a Family Child Care Home-(g)The home shall be free...but not be limited to: (4) Poisons, detergents, cleaning compounds, medicines,...shall be stored where they are inaccessible to children. LPA observed toxic items accessible to children. This requirement was not met as evidenced by: Children had access to toxic substances in the playroom. This is a potential risk to children in care.

  • 102425(e)Type B

    102425 Infant Safe Sleep-(e) No infant shall be forced to sleep, to stay awake, or to stay in the designated sleeping area. This requirement was not met as evidenced by: Licensee described to LPA that when an infant wakes up and is making noise it wakes the other children up. C1 needs to stay quiet on his mat until the rest of the children are awake. This is a potential risk to children in care.
