What the inspector wrote

Most parents stated they have never observed any concerning \342\200\234rough play\342\200\235 or aggressive behavior from children at the facility. Also most parents stated how they receive notifications of unusual incidents either through a virtual application, a physical written report or through verbal communication. During LPA record review of UIRs, LPA discovered one UIR that was self-reported by the facility to Child Care Licensing (CCL). The UIR states, on 04/18/2024 at approximately 11:15am, C#1 and C#2 were having a disagreement in the play yard with regard to a toy helicopter. Staff(lead teacher) spoke to the two children and Lead teacher felt the situation was resolved. Afterwards lead teacher observed C#1 crying. C#1 stated C#2 put hands around C#1\342\200\231s neck. There were two staff in the play yard providing care and supervision but neither of the two staff observed C#1 being choked by C#2. LPA conducting staff interviews, in particularly LPA interviewed staff#2 and staff #3. Both staff#2 and staff#3 confirmed they did not observe the allegation of C#2 choking C#1. Director also stated after hearing the alleged incident, she interviewed the facility staff which also concluded that, no staff at the facility witnessed the aforementioned allegation/incident. LPA also reviewed the staff handbook. The staff handbook does provide a official policy and guidelines for staff when a child hurts another child. Also on page 11 of the staff-handbook it states \342\200\234Children will be physically stopped when hurting each other. The focus will then turn to resolving the conflict at hand\342\200\235. Also LPA read additional guidance being provided by the staff handbook when a child behavior becomes disruptive and harmful to other children and if a teacher and director agree that a child will need additional outside support to correct such behavior, the facility will draft a plan for the child. The plan for additional steps include parent and teacher conferences, community resources , schedule adjustment, and finally dis-enrollment of a child. Through children\342\200\231s record review, LPA discovered a parent and teacher conference did take place. This conference took place due to C#2\342\200\231s behavior. The conference discussed C#2\342\200\231s \342\200\234ABC Behavior Form\342\200\235(see LIC812). The ABC Behavior form outlined incidents C#2 had been involved in. In total there were four total incidents documented, one incident took place on 10/05/2023, two incidents took place on 10/07/2023, and one incident took place on 10/10/2023. All four incidents involved C#2 acting aggressively towards other preschool children. Continued on LIC9099-C However, LPA confirmed the facility did follow it\342\200\231s established policy when a child\342\200\231s behavior becomes to disruptive or harmful. The director met with the parent of C#2 and signed a behavior plan. Also according to the director and assistant director C#2 behavior improved once the behavior plan was established and signed. Although the above allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated. Exit Interview conducted and report was reviewed with Director Marissa Dodd. . Notice of Site Visit and appeal rights were issued. .
