What the inspector wrote

Based on LPA’s observations, interviews which corroborated by multiple staff, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 are being cited on the attached LIC9099-D. One type A deficiency was issued during today’s inspection. LPA’s D. Roman and S. Martinez informed Assistant Director and Program Coordinator that this reported dated 09/11/2024 documents one (1) type A citation which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care. Also, LPA’s D. Roman and S. Martinez informed the Director's of their responsibility to provide a copy of this licensing report dated 09/11/2024 that documents the type A citation to parents / guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents / guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC9224) or other written statement must be placed in the child's file for verification. A notice of Site Visit (LIC9213) was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. The notice of site visit must remain posted for 30 days or a civil penalty of $100 will be assessed. Appeal Rights (LIC9058) were provided to the Assistant Director and Program Coordinator/Director. Exit interview conducted and report was reviewed with the Program Coordinator/Director, Jaqueline Serrano and Assistant Director, Jessica Cruz.

    (a) The licensee shall ensure that each child is accorded the following personal rights: (3)To be free from corporal or unusual punishment...or other actions of a punitive nature...including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Based on observation and interviews the center violated children's personal rights which poses a potential Health and Safety and Personal Rights risk to persons in care.

  • REPORTING REQUIREMENTS

    101212 Reporting Requirements(d)(1) Upon the occurrence...of the events specified below, a report shall be made to the Department...Events reported shall include the following: Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidence by: Based on observation, interview and record review, the licensee did not report incidents which poses potential Health and/or, Safety and, Personal Rights risk to persons in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision...to meet the children's needs.(1)No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met as evidence by: Based on LPA's observations and interviews the licensee did not comply with the section cited above as a child was left unattended for more than 5 minutes which posed a potential health, safety or personal rights risk to persons in care.
