What the inspector wrote

On September 11, 2024 Licensing Program Analyst's (LPA's) Susana Martinez and David Roman conducted an unannounced case management-other inspection. LPA's met with program coordinator, Jacqueline Serrano and Assistant Director, Jessica Cruz advised them of the purpose for the inspection. LPA's toured the facility inside and outside, at the time of the inspection there were 70 children in care of 11 staff. While initiating a complaint on 05/07/2024, it was disclosed by the center that a child was left unattended in a room upstairs while the rest of the classroom was downstairs. Child was found in the upstairs room by a facility staff. Child was inside the room with the lights off. Although the child was not injured, they were found in distress and unsupervised. The center failed to report the incident to the Department. The center staff also stated that a new director has been appointed at the beginning of September. LPA's reminded assistant director and program coordinator to report a change of child care center director or designee to the Department within 10 days of the change. During today's inspection two type B citations are being issued and can be found on the attached 809-D regarding the following Title 22 regulations: Responsibility for Providing Care and Supervision 101229(a)(1). Reporting Requirements 101212(d)(1)(C). A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted, appeal rights were given, and report was reviewed with Program Coordinator/Director, Jacqueline Serrano and Assistant Director, Jessica Cruz.

This requirement was not met as evidenced by: Based on observation and interviews the center violated children's personal rights which poses a potential Health and Safety and Personal Rights risk to persons in care.

  • REPORTING REQUIREMENTS

    101212 Reporting Requirements(d)(1) Upon the occurrence...of the events specified below, a report shall be made to the Department...Events reported shall include the following: Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidence by: Based on observation, interview and record review, the licensee did not report incidents which poses potential Health and/or, Safety and, Personal Rights risk to persons in care.

  • RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

    101229Responsibility for Providing Care and Supervision (a)The licensee shall provide care and supervision...to meet the children's needs.(1)No child(ren) shall be left without the supervision of a teacher at any time... Supervision shall include visual observation. This requirement was not met as evidence by: Based on LPA's observations and interviews the licensee did not comply with the section cited above as a child was left unattended for more than 5 minutes which posed a potential health, safety or personal rights risk to persons in care.
