What the inspector wrote

LPA learned that the facility went through several staffing changes during the period between March - May 2022. LPA was able to corroborate that the May 25, 2022, incident was witnessed by a staff member, who promptly intervened. The statements made by the staff member indicated that no preventative measures were taken to monitor the two children or prevent the incident. The staff member explained that she was not aware of previous incidents between the two children; however, LPA learned other staff members had been aware of at least one of the previous incidents between the same two children. Based on a preponderance of evidence obtained the complaint regarding the above allegation was SUBSTANTIATED. A Type A deficiency was cited on the subsequent page (LIC9099-D) of this report. Upon receipt of Type A citations, Program Lead shall post and provide copies of the LIC9099-D for parents/guardians of children in care and for parents/guardians of newly enrolled children for the next 12 months. Program Lead must also keep the signed LIC9224, Acknowledging Receipt of LIC9099-D in each child's file. An Exit Interview was conducted in which the report was reviewed and discussed with Program Lead. A copy of the report and Appeal Rights were provided. A notice of site visit was posted by LPA and Program Lead understand that the notice must remain posted for 30 days. A failure to comply with the positing requirements shall result in an immediate civil penalty of $100. LPA learned that the facility went through several staffing changes during the period of March - May 2022. LPA was unable to obtain consistent statements regarding the alleged first two incidents; however, LPA was able to corroborate that the May 25, 2022, incident was witnessed by a staff member, who promptly intervened. Based on the information obtained throughout the course of this investigation, the above allegation could not be substantiated or dismissed. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the finding is UNSUBSTANTIATED. An Exit Interview was conducted in which the report was reviewed and discussed with Program Lead. A copy of the report and Appeal Rights were provided. A notice of site visit was posted by LPA and Program Lead understand that the notice must remain posted for 30 days. A failure to comply with the positing requirements shall result in an immediate civil penalty of $100.

This poses and immediate risk to the health and safety of children in care.
