What the inspector wrote

The department has found the complaint to be SUBSTANTIATED: meaning that the allegations are valid because the preponderance of the evidence standard has been met. Title 22 Deficiencies have been cited on the subsequent LIC 9099-D page. Upon receipt of Type A citations, the facility shall post and/or provide copies of the LIC 9099-D to parents/guardians of children currently in care and to parents/guardians of newly enrolled children for the next 12 months. Facility must also provide and have parents/guardians sign the LIC 9224, Acknowledging Receipt of Licensing Reports LIC 9099-D. The facility must keep the signed LIC 9224 forms in each of the children\342\200\231s files. Exit interview was conducted at which time the report was reviewed with Licensee, Maritza Gross Gaitan. A Notice of Site Visit was posted by LPA and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00.

    Staffing Ratio and Capacity (a) The capacity specified on the license shall be the maximum number of children for whom care may be provided at any one time. This requirement was not met as evidence by: It was revealed to LPA through staff interviews that the facility had fifteen children in care on or around 10/31/23. This poses an immediate health and safety risk to children in care.

    INFANT SAFE SLEEP

    Infant Safe Sleep (b) Cribs or play yards shall be free from all loose articles and objects. This requirement was not met as evidence by: LPA observed a pillow inside one of the cribs. Through interviews with the Licensee, it was revealed that an infant is placed to sleep with the pillow during nap times. This poses an immediate health and safety risk to children in care.
