What the inspector wrote

Based on interviews, file review, and observations conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A Type-A Deficiency is cited on a subsequent 9099-D page. An exit interview was conducted, and the report was reviewed with the Assistant Director, Diana Gonzalez. LPA provided the Assistant Director with Appeal Rights. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Based on the information obtained throughout the course of this investigation for the above allegations, LPA Tedlos determined that the allegations were found to be UNSUBSTANTIATED, meaning although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur. An exit Interview was conducted with the Assistant Director, Diana Gonzalez. A notice of site visit was provided and must remain posted for 30 days.

    (a) Notwithstanding Section 101230, the following shall apply:...(3) All infants shall be given the opportunity to sleep without distraction or disturbance from other activities at the center whenever the infant desires...(C) An infant shall not be swaddled while in care...This was not met as evidenced by:LPA learned that a child was swaddled in care.This poses an immediate health & safety risk to children in care.
