Based on record review, the licensee did not comply with the section cited above in two out of two staff records missing current mandated reporter certificate which poses/posed a potential health, safety or personal rights risk to persons in care.

CHILD'S MEDICAL ASSESSMENTS

Based on record review, the licensee did not comply with the section cited above in One count of C2 missing Physicians report which poses/posed a potential health, safety or personal rights risk to persons in care.

ARTICLE 3. Administration

Based on observation and record review, the licensee did not comply with the section cited above, Facility completed lead testing on 6/28/23 which poses/posed a potential health, safety or personal rights risk to persons in care.

1596.99(c)(3)(c) The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, for any of the following serious violations:(3) Absence of supervision, including, but not limited to, a child left unattended, and supervision of a child by a person under 18 years of age... This requirement was not met as evidenced by: Based on interviews child (C1) was usupervised for approximately 10 minutes on the playground. An immediate civil penalty of $500 applies. This poses an immediate health and safety risk to children in care.

101226.1(a)(1)(B) The licensee shall be responsible for ensuring that children with obvious symptoms of illness including, but not limited to, fever or vomiting, are not accepted.(1)Additional attention shall be paid to children who: (B)Have been exposed to a contagious disease. This requirement was not met as evidenced by: Based on interviews stating the facility was experiencing an outbreak of a contagious disease which C1 was exposed to. This poses a potential health and safety risk to children in care

REPORTING REQUIREMENTS

Upon the occurrence... a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information...shall be submitted to the Department within seven days following the occurrence of such event.(1)Events reported shall include the following:(E) Epidemic outbreaks. This requirement was not met as evidenced by: during an interview it was determined the facility had experienced an outbreak of hand-foot-mouth and did not notify the department or public health, which poses a potential risk to the health and safety of children in care.
