What the inspector wrote

Based on evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22) and/or California Health & Safety Code, is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted. An immediate civil penalty of $500 was assessed for the absence of supervision. Reports citing Type A violations are to be provided to parents/guardians of children currently enrolled and to parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must sign Form LIC 9224 to be kept in each child's file. The Notice of Site Visit must be posted for 30 days.

This requirement was not met as evidenced by: Based on interviews, Licensee did not report a child who left the facility as required by the aforementioned regulations.

    1597.58(c)(2)The department shall assess an immediate civil penalty of five hundred dollars ($500) per violation...for any of the following serious violations (2)Absence of supervision, including, but not limited to, a child left unattended... This requirement was not met as evidenced by: Based on interviews child (C1) was unsupervised, left the facility, and was found outside the facility by a passerby. An immediate civil penalty of $500 applies. This poses an immediate health and safety risk to children in care.
