What the inspector wrote

F600 §483.12(a)(1) Freedom from Abuse, Neglect, and Exploitation The resident has the right to be free from abuse, neglect, misappropriation of resident property, and exploitation as defined in this subpart. This includes but is not limited to freedom from corporal punishment, involuntary seclusion and any physical or chemical restraint not required to treat the resident's medical symptoms. §483.12(a) The facility must- §483.12(a)(1) Not use verbal, mental, sexual, or physical abuse, corporal punishment, or involuntary seclusion On 4/13/21 at 4:40 p.m., an unannounced visit was conducted at Westwood Post-Acute to investigate an Entity Reported Incident and Complaint for Quality of Care/Treatment, Resident Safety. The facility failed to ensure Resident 151 was free from physical and mental abuse when certified nursing assistant FF (CNA FF) slapped Resident 151 on the face. This failure had the potential to impact the physical and mental well-being of Resident 151. Review of Resident 151's clinical record, indicated Resident 151 had diagnoses of unspecified dementia (impaired ability to remember, think, or make decisions that interferes with doing everyday activities) with behavioral disturbance, Alzheimer's Disease Unspecified. Resident 151's Minimum Data Set (MDS, an assessment tool), dated 3/23/21, indicated her cognition was severely impaired. During an interview on 4/15/21 at 1:20 p.m., with the assistance of maintenance supervisor (MS) to interpret, Resident 87 stated he was in his room and heard yelling coming from Room B. Resident 87 went to Room B and saw CNA FF slap Resident 151 on the face. Resident 87 saw LS U in the hallway and immediately reported what he saw. Resident 87 and LS U both went to Room B. During an interview on 4/15/21 at 11:25 a.m., with the assistance of MS to interpret, LS U stated she was in the hallway on Station 5, near Room A, and was called by Resident 87 to go to Room B. LS U immediately opened the curtains and saw CNA FF slap Resident 151 on the face four times. Resident 151 was in bed and looked scared. LS U told CNA FF "don't do that" and "I'm going to report you", CNA FF then stopped. LS U immediately reported the incident to licensed vocational nurse V (LVN V). During a telephone interview with LVN V on 4/15/21 at 6: 30 p.m., LVN V stated LS U reported she saw CNA FF slap Resident 151 in Room B. LVN V immediately moved Resident 151 from Room B back to her room at Room C. A review of the IDT Progress Notes, dated 4/13/21, indicated laundry staff allegedly claimed she saw the CNA "slap" resident [Resident 151] while they were in Room B. A review of Resident 151 undated Care Plan Detail indicated a care plan for allegation of a staff to resident abuse involving the resident and a CNA. Laundry staff allegedly reported to charge nurse that CNA slapped the resident while in the room. A review of the "Allegation of Abuse Investigation", dated 4/12/21, indicated Resident 87 and LS U observed CNA FF slap the resident on the face in Room B. CNA FF was suspended and terminated for unprofessional behavior. During an interview with the ADM on 4/26/21 at 1:06 p.m., the ADM stated CNA FF's behavior was not to be tolerated and the facility decided to separate ways with CNA FF. A review of the facility's undated document, "Overview Recommended Key Components of Systemic Approach to prevent Abuse," indicated the facility or system has the capacity to prevent abuse and neglect..." In violation of the above cited standards, the facility failed to ensure Resident 151 was free from physical and mental abuse when certified nursing assistant FF (CNA FF) slapped Resident 151 on the face. This failure had the potential to impact the physical and mental well-being of Resident 151. The above violation caused or occurred under circumstances likely to cause significant humiliation, indignity, anxiety, or other emotional trauma to the resident.
