F623 10/24/2018 §483.15(c)(3) Notice before transfer. Before a facility transfers or discharges a resident, the facility must(i) Notify the resident and the resident's representative(s) of the transfer or discharge and the reasons for the move in writing and in a language and manner they understand. The facility must send a copy of the notice to a representative of the Office of the State LongTerm Care Ombudsman. (ii) Record the reasons for the transfer or discharge in the resident's medical record in accordance with paragraph (c)(2) of this section; and (iii) Include in the notice the items described in paragraph (c)(5) of this section. §483.15(c)(4) Timing of the notice. (i) Except as specified in paragraphs (c)(4)(ii) and (c)(8) of this section, the notice of transfer or discharge required under this section must LABORATORY DIRECTOR'S OR PROVIDER/SUPPLIER REPRESENTATIVE'S SIGNATURE TITLE (X6) DATE Any deficiency statement ending with an asterisk (*) denotes a deficiency which the institution may be excused from correcting providing it is determined that other safeguards provide sufficient protection to the patients . If the information in the notice changes prior to effecting the transfer or discharge, the facility must update the recipients of the notice as soon as practicable once the updated information becomes available. §483.15(c)(8) Notice in advance of facility closure In the case of facility closure, the individual who is the administrator of the facility must provide written notification prior to the impending closure to the State Survey Agency, the Office of the State Long-Term Care Ombudsman, residents of the facility, and the resident representatives, as well as the plan for the transfer and adequate relocation of the residents, as required at § 483.70(l). This REQUIREMENT is not met as evidenced by: Based on interview and record review, the facility failed to provide a written notice of discharge to one resident (Resident 1) in a census of 114, and send a copy of the notice to the Office of the State Long-Term Care Ombudsman. This failure had the potential to contribute to the resident not knowing his appeal rights. He had diagnoses that included metabolic encephalopathy (a condition that negatively affects brain function), dementia, and a history of a traumatic brain injury. The Admission Record indicated Resident 1's daughter was the Responsible Party (RP, a person authorized to make medical decisions for a resident). During a review of Resident 1's clinical record, a Social Services Progress Note, dated 2/13/18, indicated the Social Services Director (SSD) met with the resident and his RP to discuss discharge planning. The last day of insurance coverage for physical therapy was discussed along with the option to apply for Medi-Cal (State administered health plan). Follow-up Social Services Progress Notes dated 2/21/18, 2/22/18, and 2/23/18, indicated discussions with the RP on discharge planning, referrals to assisted living facilities, and estimated share of cost for the resident's stay past the last day of insurance coverage. During an interview with the SSD on 9/7/18 at 1:15 p.m., she stated the facility did not notify Resident 1 or his RP in writing of his discharge date, nor did they notify the Office of the State Long-Term Care Ombudsman of the discharge. During an interview with the RP on 9/25/18 at 3:10 p.m., the RP stated she met with the SSD on 2/13/18 and was informed of Resident 1's last day of insurance coverage on 2/16/18. The RP stated, that meeting was the first time discharge planning was discussed. A facility policy and procedure titled "Transfer or Discharge Notice" revised December 2016, indicated, "Our facility shall provide a resident and/or the resident's representative (sponsor) with a thirty (30)-day written notice of an impending transfer or discharge...Under the following circumstances, the notice will be given as soon as it is practicable but before the transfer or discharge...The resident has not resided in the facility for thirty (30) days...," and "A copy of the notice will be sent to the Office of the State Long-Term Care Ombudsman."
