What the inspector wrote

California Health and Safety Code, 1418.91 (a) A long-term health care facility shall report all incidents of alleged abuse or suspected abuse of a resident of the facility to the department immediately, or within 24 hours (b) A failure to comply with the requirements of this section shall be a class "B" violation. The following citation is written as a result of facility reported incident #CA00736402. An unannounced visit was made to the facility on 05/27/21 to investigate an allegation of abuse. The Department determined the facility failed to: Report suspected abuse of Resident A by Licensed Nurse (LN) 1 within 24 hours as required, when a sexual abuse claim was first made on 5/8/21 and the facility reported it on 5/12/21. This violation had the potential to place Resident A at an increased risk for physical harm and psychosocial harm. Findings: A review of Resident A's Admission Record indicated, Resident A was admitted to the facility in April of 2021. According to the Minimum Data Set (MDS, an assessment tool) dated 4/6/21, Resident A scored 12 out of 15 in a Brief Interview for Mental Status (BIMS) which indicated she had moderate cognitive impairment (reasoning, understanding and memory are mildly affected). During an interview with Resident A on 5/27/21, at 11:12 a.m., Resident A stated she felt "sad" when incident with male nurse happened and she reported to the nurse the same evening of the incident. On 5/12/21, the CA Department of Public Health received a report alleging sexual abuse of Resident A by LN 1. A review of Resident A's "Progress Notes", dated 5/8/21, at 6:54 p.m., indicated, "Resident alleged male staff of touching her perineal area...staff reported the resident statement to the Supervisor on duty..." During an interview with the Administrator on 5/27/21, at 3:42 p.m., the Administrator confirmed that LN 1 should have called her right away about the sexual abuse claim and she would have directed LN 1 to report the incident immediately to the proper agencies. During a phone interview with LN 1, on 5/28/21, at 3:36 p.m., LN 1 confirmed that the sexual abuse allegation should have been reported right away, which included to call the administrator, fill out a report and notify the proper authorities. During a phone interview with the Social Services Director (SSD), on 7/1/21, at 2:38 p.m., SSD confirmed that the facility expectation for receiving any abuse claim needed to be reported immediately. Review of a facility policy and procedure (P&P), dated November 2016, titled, "Abuse Prevention, Intervention, Investigation & Crime Reporting Policy", indicated, "...Ensure that all alleged violations involving abuse, neglect, exploitation or mistreatment,...are reported immediately;..." Therefore, the Department determined the facility failed to report suspected abuse of Resident A by LN 1 within 24 hours as required, when a sexual abuse claim was first made on 5/8/21 and the facility reported it on 5/12/21.
