F0000 INITIAL COMMENTS F0000 /2026 An unannounced recertification survey with complaint numbers 2025000032, 202500098, 2025010853, 2025017459, and 2026000378 was conducted through Life Care Center of Estero, a nursing home in Estero, Florida. Life Care Center of Estero is not in compliance with the Code of Federal Regulations (CFR) 42, Part 483 Requirements for Long-Term Care Facilities. The following is the description of the noncompliance.

The facility must - $483.60(i)(1)- Procure food from sources approved or considered satisfactory by federal, state or local authorities. (i) This may include food items obtained directly from local producers, subject to applicable State and local laws or regulations. (ii) This provision does not prohibit or prevent facilities from using produce grown in facility gardens, subject to compliance with applicable safe growing and food-handling practices. Based on observation, review of facility's policies and The plan of correction is submitted as required under Federal and State regulations and statutes applicable to long-term care providers. This plan of correction does not constitute an admission of liability on the part of the facility and an admission of liability is hereby specifically denied. This plan of correction constitutes our written allegation of compliance. No residents were identified to be affected by not ensuring the proper storage of refrigerated food. The bag of cantaloupe and the box of bacon slices were discarded. Additional areas of the facility where food is stored were inspected and no additional concerns were identified. Facility residents who consume an oral diet have the potential to be affected by not ensuring the proper storage of refrigerated food. The facility posted signage throughout the kitchen with reminders for labeling and dating. The Director of Food Service added the task of verifying the labeling and dating, and ensuring refrigerated food is stored according to professional standard to the evening assignment. The Director of Food Service and/or designee educated the kitchen staff on ensuring storage of refrigerated food is completed according to professional standards including the labeling and dating of foods, and the storage of pre-packaged refrigerated foods. This has the potential to affect all 150 residents who consume an oral diet at the facility. The findings included: On at 9:26 a.m., observation of the food in the walk-in refrigerator revealed: An undated bag of cantaloupe. A box of slices of bacon stored in an opened card box without appropriate covering or containment. The slices of bacon were exposed to air and were not stored in a sealed container. In an interview during the observation, the Director of Food Service verified that the bacon was not stored in a sealed container and verified the bag of cantaloupe was undated. *Photographic evidence obtained.* Review of the facility's policy for Food Safety with an effective date of and a review date of revealed Policy: Food is stored and maintained in a clean, safe and sanitary manner following federal, state, and local guidelines to minimize contamination and growth. Procedure: Pre-packaged food is placed in a leak-proof, pest-proof, non-absorbent, sanitary (NSF) container with a tight-fitting lid. The container is labeled with the name of the contents and date (when the item is transferred to the new container). "Use By Date" is noted on the label or product when applicable.
