T22 DIV5 CH3 ART5-72539- Reporting Outbreaks Any outbreak or undue prevalence of infections or parasitic disease or infestation shall be reported to the local health office in accordance with Section 2502, Article 1, Subchapter 4, Chapter 4, Title 17, California Administrative Code. T22 DIV5 CH3 ART5-72541- Unusual Occurrences Occurrences such as epidemic outbreaks, poisonings, fires, major accidents, death from unnatural causes or other catastrophes and unusual occurrences which threaten the welfare, safety or health of patients, personnel or visitors shall be reported by the facility within 24 hours either by telephone (and confirmed in writing) or by telegraph to the local health officer and Department. According to the AFL (All Facility Letter) 20-43.3, dated June 19,2020, “…Failure to report…Facilities that fail to comply with the daily SNF reporting requirement may also be subject to a B Citation… All SNF (Skilled Nursing Facility) to report daily COVID-19 facility data to the California Department of Public Health via an online survey…" During the record review on September 21, 2020, the facility failed to submit COVID-19 Daily Reporting Survey on the following dates: 1. 7/19/2020; 2. 7/26/2020; 3. 8/18/2020; 4. 8/29/2020; and 5. 9/10/2020. On September 22, 2020, at 9:10 a.m., a record review was conducted with the Director of Nursing (DON). During a concurrent interview, the DON confirmed the non-submittal of daily reports on 7/19/2020, 7/26/2020, 8/18/2020, 8/29/2020, and 9/10/2020. The facility failed to timely report COVID-19 Survey on five separate occasions. These failures resulted in incomplete data reported to the Department necessary to respond to the COVID-19 outbreaks and had the potential to compromise the medical health and safety of patients, staff and or visitors. This violation had a direct or immediate relationship to the health, safety, or security of patients or residents.
