§72329.1(i) Nursing Service – Staff The facility shall post the patient census and staffing information daily. The posting shall include the actual number of licensed and certified nursing staff directly responsible for the care of patients for that particular day on each shift. The facility may use the form it currently uses to comply with the requirements of section 483.30 of title 42 of the Code of Federal Regulations, but, in addition to the information the federal regulation requires it to contain, it shall also designate the patient assignment by specifying each room and each bed to which each certified nurse assistant is assigned during his or her shift, and shall additionally specify the assignment of each licensed nurse and any other direct caregiver not assigned to a specific room or beds. This posting shall be publicly displayed in a clearly visible place. §483.35(i) Nurse Staffing Information. §483.35(i)(1) Data requirements. The facility must post the following information on a daily basis: (i) Facility name. (ii) The current date. (iii) The total number and the actual hours worked by the following categories of licensed and unlicensed nursing staff directly responsible for resident care per shift: (A) Registered nurses. (B) Licensed practical nurses or licensed vocational nurses (as defined under State law). (C) Certified nurse aides. (iv) Resident census. §483.35(i)(2) Posting requirements. (i) The facility must post the nurse staffing data specified in paragraph (i)(1) of this section on a daily basis at the beginning of each shift. (ii) Data must be posted as follows: (A) Clear and readable format. (B) In a prominent place readily accessible to residents, staff, and visitors. On 12/1/2025, the California Department of Public Health (CDPH) made an unannounced visit to conduct the annual recertification survey. The facility failed to ensure the residents’ census and staffing information, including the actual hours worked by licensed and unlicensed nursing staff directly responsible for resident care per shift, were posted daily for two of two days (on 11/29/2025 and on 11/30/2025). On 12/1/2025, at 7:30 a.m., the nurse staffing information (a staffing metric used by skilled nursing facilities [SNFs] to measure the number of direct care hours provided to residents over a 24-hour period) posted at the facility’s reception desk and on the staffing whiteboard (a dry erase board indicating the facility’s census, shifts and the amount of registered nurses [RNs], licensed vocational nurses [LVNs], and Certified Nursing Assistants [CNAs] working, and the total hours worked per shift) next to the activity room entrance, were dated 11/28/2025. The nurse staffing information for 11/29/2025 and 11/30/2025 were not posted or updated at either location. As a result, the residents and visitors were unaware of the total number of staff and the actual staff working hours in the facility. During an observation on 12/1/2025 at 7:30 a.m., the staffing information posted at both the facility’s reception desk and on the staffing whiteboard located next to the activity room entrance, was dated 11/28/2025.   During an observation on 12/1/2025 at 8:28 a.m., the staffing information posted at both the facility’s reception desk and on the staffing whiteboard located next to the activity room entrance, was dated 11/28/2025. During a concurrent record review and interview on 12/1/2025 at 8:46 a.m., with Registered Nurse 1 (RN 1), photographs taken on 12/1/2025 at 8:28 a.m., of the staffing information posted at the facility’s reception desk and on the staffing whiteboard next to the activity room entrance dated 11/28/2025 were reviewed. RN 1 stated the photographs indicated the daily staffing information was dated 11/28/2025. RN 1 stated that the DSD is responsible for updating the whiteboard and posting the form which includes the residents’ census and staffing information such as the actual hours worked by the licensed and unlicensed nursing staff directly responsible for resident care per shift, at the reception desk. RN 1 further stated that the daily staffing posting should have been updated, as visitors and family members would otherwise be unaware of the number of staff working that day and may think there was insufficient staff available to meet residents’ care needs.   During an interview on 12/1/2025 at 9:21 a.m., with the DSD, the DSD stated that staffing information posting should be updated and posted daily. The DSD stated he (DSD) is responsible for changing the daily staffing posting. The DSD stated that the purpose of posting staffing information daily is to show that the facility can provide quality of care within normal staffing hours. The DSD further stated that the staff information since Saturday (11/29/2025) was not updated and posted in a timely manner and that he (DSD) updated the postings upon his arrival at the facility on 12/1/2025. The DSD stated that the receptionist had previously been assigned responsibility for updating the daily staffing postings during the weekends and holidays. The DSD stated that the daily staffing postings should have been updated so that visitors and/or family members would be aware that the facility had sufficient staff to provide quality care to the residents.     During an interview on 12/2/2025 at 9 a.m., with the Director of Nursing (DON), the DON stated he (DON) was made aware that the daily staffing posting had not been updated since 11/28/2025 and remained unchanged until 12/1/2025. The DON stated that, per facility policy, daily staffing information is required to be updated and posted at the start of each shift. The DON further stated that reception desk staff were assigned responsibility for posting the daily staffing information and that the postings should have been updated daily so visitors and/or family members would be aware that the facility had sufficient staff to provide quality care to residents.     A review of the facility’s policy and procedure (P&P) titled, “Posting Direct Care Daily Staffing Number,” last reviewed on 1/2/2025, indicated, the facility will post on a daily basis for each shift nursing data, including the number of nursing personnel responsible for providing direct care to residents. The P&P further indicated:  * Within two (2) hours of the beginning of each shift, the number of licensed nurses and the number of unlicensed personnel directly responsible for resident care is posted in a prominent location (accessible to residents and visitors) and in a clear and readable format  * Directly responsible for resident care means that individuals are responsible for resident’s total care or some aspect of the resident’s care including but not limited to: assisting with activities of daily living (ADLs - routine tasks/activities such as bathing, dressing and toileting a person performs daily to care for themselves), administering medications, supervising care provided by CNAs, and performing nursing assessments. Shift staffing information is recorded on a form for each shift. The information recorded on the form shall include the following information:  * The name of the facility  * The current date (the date for which the information is posted)  * The current census at the beginning of the shift for which the information was posted  * 24-hour shift schedule operated by the facility  * The shift for which the information is posted  * Type and category of nursing staff working during that shift who are paid by the facility (including contract staff)  * The actual time worked during that shift for each category and type of nursing staff; and  * Total number of licensed and non-licensed nursing staff working for the posted shift.  The facility failed to ensure the residents’ census and staffing information, including the actual hours worked by licensed and unlicensed nursing staff directly responsible for resident care per shift, were posted daily for two of two days (on 11/29/2025 and on 11/30/2025). On 12/1/2025, at 7:30 a.m., the nurse staffing information posted at the facility’s reception desk and on the staffing whiteboard next to the activity room entrance, were dated 11/28/2025. The nurse staffing information for 11/29/2025 and 11/30/2025 were not posted or updated at either location. As a result, the residents and visitors were unaware of the total number of staff and the actual staff working hours in the facility. The above violation had direct or immediate relationship to the health, safety, or security of all residents in the facility.
