§72329.1(i) Nursing Service – Staff The facility shall post the patient census and staffing information daily. The posting shall include the actual number of licensed and certified nursing staff directly responsible for the care of patients for that particular day on each shift. The facility may use the form it currently uses to comply with the requirements of section 483.30 of title 42 of the Code of Federal Regulations, but, in addition to the information the federal regulation requires it to contain, it shall also designate the patient assignment by specifying each room and each bed to which each certified nurse assistant is assigned during his or her shift, and shall additionally specify the assignment of each licensed nurse and any other direct caregiver not assigned to a specific room or beds. This posting shall be publicly displayed in a clearly visible place. §483.35(i) Nurse Staffing Information. §483.35(i)(1) Data requirements. The facility must post the following information on a daily basis: (i) Facility name. (ii) The current date. (iii) The total number and the actual hours worked by the following categories of licensed and unlicensed nursing staff directly responsible for resident care per shift: (A) Registered nurses. (B) Licensed practical nurses or licensed vocational nurses (as defined under State law). (C) Certified nurse aides. (iv) Resident census. §483.35(i)(2) Posting requirements. (i) The facility must post the nurse staffing data specified in paragraph (i)(1) of this section on a daily basis at the beginning of each shift. (ii) Data must be posted as follows: (A) Clear and readable format. (B) In a prominent place readily accessible to residents, staff, and visitors. On 10/21/2025, the California Department of Public Health (CDPH) made an unannounced visit to the facility to investigate a complaint regarding quality of care. The facility failed to post residents’ census and Direct Care Service Hours Per Patient Day (DHPPD - a staffing metric used skilled nursing facilities [SNFs] to measure the number of direct care hours provided to patients over a 24-hour period) daily between 10/18/2025 to 10/21/2025. On 10/21/2025 at 10:06 a.m., it was observed that DHPPD posted in the facility’s lobby and at Nursing Station 1 was dated 10/17/2025. The DHPPDs for 10/18/2025, 10/19/2025, 10/20/2025, and 10/21/2025 were not posted by the facility at the facility lobby and Nursing Station 1. As a result, the residents and visitors were unaware of the total number of staff and the actual staff working hours in the facility. During a concurrent observation and interview on 10/21/2025 at 10:06 a.m. with the Operations Manager (OM), observed the DHPPD, dated 10/17/2025, posted at the facility lobby and at Nursing Station 1. The OM stated the posted DHPPD was not current. The OM stated the DHPPD should have been posted at the lobby and at the nursing stations at the start of the 7 a.m. to 3 p.m. shift. During an interview on 10/21/2025 at 1:05 p.m. with the Director of Staff Development (DSD), the DSD stated the DSD, Assistant DSD (ADSD), or the 11 p.m. to 7 a.m. shift Registered Nurse (RN) should post the DHPPD within two hours after the start of the 7 a.m. to 3 p.m. shift. The DSD stated DHPPDs were posted to notify the residents, visitors, and facility staff that the facility was adequately staffed to provide resident care and services. The DSD stated the facility failed to ensure the nursing staffing information was current and posted daily. A review of the facility’s policy and procedure (P&P) titled, “Posting Direct Care Daily Staffing Numbers,” last reviewed on 5/30/2025, the P&P indicated the “… facility will post on a daily basis for each shift nurse staffing data, including the number of nursing personnel responsible for providing direct care to residents.” The P&P indicated “within two (2) hours of the beginning of each shift. The number of licensed nurses… and the number of unlicensed nursing personnel… directly responsible for resident care is posted in a prominent location (accessible to residents and visitors) and in a clear and readable format.”   The facility failed to post residents’ census and DHPPD daily between 10/18/2025 to 10/21/2025. On 10/21/2025 at 10:06 a.m., the DHPPD posted in the facility’s lobby and at the Nursing Station 1 was dated 10/17/2025. The DHPPDs for 10/18/2025, 10/19/2025, 10/20/2025, and 10/21/2025 were not posted by the facility at the facility lobby and Nursing Station 1. As a result, the residents and visitors were unaware of the total number of staff and the actual staff working hours in the facility. The above violation had direct or immediate relationship to the health, safety, or security of residents.
