§72327 Nursing Service - Director of Nursing Service (b) The director of nursing service shall have at least one year of experience in nursing supervision within the last five years On 11/4/2025, the California Department of Public Health (CDPH) received a complaint alleging the facility's current Director of Nursing (DON) does not meet the minimum experience required for the DON position. On 11/12/2025, CDPH conducted an unannounced visit to the facility to investigate the complaint allegation. Upon investigation, CDPH determined the facility's current DON was a newly licensed Registered Nurse (RN) without at least one year of RN experience in nursing supervision within the last five years. The facility failed to ensure: 1. The facility's DON, who was hired on 11/3/2025, had the minimal qualifying experience as a RN, per regulation, to qualify for the DON position. This deficient practice resulted in the facility hiring an RN who received their RN license on 7/21/2025 and had only been an RN for less than four months when hired by the facility on 11/3/2025. This deficient practice had the potential to negatively affect the care provided to residents in the facility as directed by an unqualified DON. A review of the DON's Personnel Record indicated the DON was hired by the facility on 11/3/2025 to fill the facility's open DON position. A review of the Department of Consumer Affairs (DCA) license lookup indicated the facility's newly hired DON was issued an RN license on 7/21/2025. A review of the DON's Employment Application and Resume indicated the DON had no previous supervisory experience as an RN. During an interview on 11/12/2025 at 7:12 a.m., the DON stated he was hired by the facility on 11/3/2025, for the position of DON. The DON stated he received his RN license on 7/21/2025. During an interview on 11/12/2025 at 10:16 a.m., the Administrator (ADM), after reviewing the DON's resume, stated the DON only had supervisory experience as a Licensed Vocational Nurse (LVN) but not as an RN. During a review of the facility's undated Job Description, titled "Director of Nursing" the Job Description indicated, the Director of Nursing is responsible for supervising and managing the Assistant DON (ADON) and entire nursing staff either directly or indirectly (approximately 11 Registered Nurses, 44 Licensed Vocational Nurses and120 Certified Nursing Assistants for approximately 150 residents). The facility failed to ensure: 1. The facility's DON, who was hired on 11/3/2025, had the minimal qualifying experience as a RN, per regulation, to qualify for the DON position. This deficient practice resulted in the facility hiring an RN who received their RN license on 7/21/2025 and had only been an RN for less than four months when hired by the facility on 11/3/2025. This deficient practice had the potential to negatively affect the care provided to residents in the facility as directed by an unqualified DON. These violations, jointly, separately or in any combination, had direct or immediate relationship to the health, safety, or security and welfare of Resident 1.
