California Code, Health and Safety Code - HSC § 1418.21 (a) A skilled nursing facility that has been certified for purposes of Medicare or Medicaid shall post the overall facility rating information determined by the federal Centers for Medicare and Medicaid Services (CMS) in accordance with the following requirements: (1) The information shall be posted in at least the following locations in the facility: (A) An area accessible and visible to members of the public. (B) An area used for employee breaks. (C) An area used by residents for communal functions, such as dining, resident council meetings, or activities. (2) The information shall be posted on white or light-colored paper that includes all of the following, in the following order: (C) The most recent overall star rating given by CMS to that facility, except that a facility shall have seven business days from the date when it receives a different rating from CMS to include the updated rating in the posting. The star rating shall be aligned in the center of the page. The star rating shall be expressed as the number that reflects the number of stars given to the facility by CMS. The number shall be in a clear and easily readable font of at least two inches print. (4) The requirements of this section shall be in addition to any other posting or inspection report availability requirements. (b) Violation of this section shall constitute a class B violation, as defined in subdivision (e) of Section 1424 and, notwithstanding Section 1290, shall not constitute a crime. Fines from a violation of this section shall be deposited into the State Health Facilities Citation Penalties Account, created pursuant to Section 1417.2. On 2/24/2026, the California Department of Public Health (CDPH) conducted an unannounced visit to the facility to investigate a complaint regarding quality of care. The facility failed to post its current Center for Medicare and Medicaid System (CMS- the federal agency that provides health coverage) star rating (CMS created the Five-Star Quality Rating System to help consumers, families, and caregivers compare nursing homes and identify areas for further inquiry. The Nursing Home Care Compare website features a quality rating system that gives each nursing home a rating from one and five stars, with five stars indicating much above- average quality and one star indicating much below-average quality) signage on 2/24/2026. As a result, the facility disseminated inaccurate information to the public regarding its CMS star rating. During an observation on 2/24/2026, at 9:22 a.m., in front of Nurse’s Station 1, a two-star rating was observed posted on the consumer’s board. A review of the Medicare website for star rating (last updated on 2/24/2026), on 2/24/2026 at 10:00 a.m., indicated the facility held a one-star rating. During a concurrent interview and record review on 2/24/2026, at 10:56 a.m., with the Assistant Administrator 1 (AA 1), the facility star rating was reviewed. AA 1 stated that the facility’s current star rating was one star. During a subsequent observation on 2/24/2026, at 2:31 p.m., in front of Nurse’s Station 1, observed a two-star rating remained posted on the consumer board. During an interview on 2/24/2026, at 4:00 p.m., with the Director of Nursing (DON), the DON stated that the facility’s current star rating is one-star; however, a two-star rating was posted on the consumer board near Nurse’s Station 1. The DON further stated that the Minimum Data Set (MDS) Nurse is responsible for updating the star rating, as the MDS nurse has access to the website. The DON stated she (DON) was unsure how frequently the star rating is checked; however, the two-star rating currently posted is inaccurate, as the facility`s current star rating is one star. During an interview on 2/24/2026, at 4:30 p.m., with the MDS Nurse, the MDS Nurse stated he (MDS Nurse) is responsible for pulling the star rating report. The MDS Nurse stated the report is generated monthly; however, he (MDS Nurse) does not physically post the star rating. The MDS Nurse further stated he (MDS Nurse) is unsure who is responsible for posting the star rating. The MDS Nurse stated that the star rating was previously provided to the DON and discussed during the monthly Quality Measures meeting. The MDS Nurse stated the facility’s star rating changed in January 2026, as the facility held a two-star rating in December 2025. The MDS Nurse stated that posting an inaccurate rating is incorrect and stated that the current star rating should be posted for residents, family members, guests, and employees to view. During an interview on 2/24/2026, at 4:50 p.m., with the DON, the DON stated that the purpose of posting the star rating is to inform residents and staff about the facility`s quality measures. The DON stated that if the posted star rating is inaccurate, residents and staff would not have accurate information. The DON further stated there is no specific policy regarding the posting of the star rating; however, the facility follows the Health and Safety Code requirements. The facility failed to post its current CMS star rating signage on 2/24/2026. As a result, the facility disseminated inaccurate information to the public regarding its CMS star rating. The above violation had a direct relationship with the health, safety, or security of the residents at the facility.
