What the inspector wrote

Title 22 § 72603 Space Conversion Spaces approved for specific uses at the time of licensure shall not be converted to other uses without the approval of the Department. § 72605 Notice to Department The Department shall be notified in writing by the owner or licensee of the skilled nursing facility, within five days of the commencement of any construction, remodeling or alterations to such facility. On 2/24/2026 the California Department of Public health (CDPH) made an unannounced visit to the facility to investigate the elevator outage and change location for dietetic (nutritional) services. The facility’s conference room was converted into a food distribution and serving area. The facility did not notify the California Department of Public Health (CDPH), and the Department of Healthcare Access Information (HCAI, the state agency that reviews and approves plans for construction, repairs, renovations, and alternations made to healthcare facilities to comply with State Building Codes previously known as the Office of Statewide health Planning and Development – OSHPD) about the change in location for dietetic services, and modifications made and the addition of new equipment to the conference room. This deficient practice had the potential to result in unsafe and unsanitary food storage and distribution practice, place staff at risk of injuries and increase residents’ risk of accidents or safety hazards due to the facility installing equipment and making structural changes without obtaining the proper permits and authorizations from the regulating agencies. During a concurrent observation and interview with Assistant Administrator (AADM) and Maintenance Supervisor (MS) on 2/24/2026 at 10:30 AM, the facility conference room was converted to a food distribution and serving area. During the same observation on 2/24/2026 at 10:30AM there was a steam table (used to hold precooked food at safe temperatures >135 degrees °F has multiple stainless-steel compartments (wells) that use heated water to produce steam and keep food warm), a plate warmer, one refrigerator (vertical commercial refrigerator with a from opening doors) meal carts (carts with shelves to transport food) a fan, a cooler and a cart for kitchen supplies. During a concurrent interview with AADM and MS on 2/24/2026, AADM stated that the elevator has been broken since last quarter of 2024. AADM stated the kitchen is in the basement and food is being delivered by staff through the stairwell and into the conference room. AADM stated the facility has tried alternative places and different methods to serve food, and the conference room location has worked out best. AADM stated food delivery service has been relocated to the conference room to set up the trays, because the elevator is not working and the kitchen is in the basement. During the same interview, MS stated before the elevator broke in 2024, there were problems with the elevator, and the repair company was providing maintenance. The repair company said the elevator should be replaced. MS stated after 10/2024 no repair was done for this elevator. During an interview with ADM on 2/26/2026 at 10:30 AM, the ADM stated they tried to fix the elevator several times, but he was informed by the repair company that the elevator was not repairable and needed to be replaced. ADM stated no further elevator repair has been done since. ADM stated the elevator was inoperable in October 2024 During the same interview with ADM on 2/26/2026 at10:35 AM stated that facility did not notify CDPH of the elevator being broken and the conference converted into a food distribution area. ADM stated facility did not inform CDPH or HCAI of the addition of the equipment in the conference room. ADM stated facility purchased additional refrigerator, added a plate warmer and steam table to make sure residents’ food stays safe in the conference room. ADM stated a couple of days ago we have submitted a request for a program flex to CDPH to be able to operate food service from the conference room. ADM stated we have been serving food from the conference room for a while and at least a year. During a review of a report from the elevator company titled “Maintenance Time Ticket” dated 4/4/2024 the maintenance report indicated, “recommend replacing oil, cleaning valves, change jacks, packing and doing 5-year load test” During a review of the “Maintenance Time Ticket” dated 5/23/24, 7/26/24; 7/31/24; 8/2/2024 report did not indicate the recommended services from previous months were done. During a review of the “Maintenance Time Ticket” dated 8/21/2024 indicated, “report due emergency alarm bell not working found broken wire replaced and checked return to service.” During a review of the “Maintenance Time Ticket” dated 9/9/2024 indicated a routine maintenance was completed. There is no other maintenance completed on the elevator after 9/9/2024. The facility’s elevator was broken, and kitchen was in the basement. The conference room upstairs was converted into a food distribution and serving area. The facility did not notify the California Department of Public Health (CDPH), and the Department of Healthcare Access ad Information (HCAI, the state agency that reviews and approves plans for construction, repairs, renovations, and alternations made to healthcare facilities to comply with State Building Codes previously known as the Office of Statewide health Planning and Development – OSHPD) about the change in location for dietetic services, and modifications made and the addition of new equipment to the conference room. This deficient practice had the potential to result in unsafe and unsanitary food storage and distribution practice, place staff at risk of injuries and increase residents’ risk of accidents or safety hazards due to the facility installing equipment and making structural changes without obtaining the proper permits and authorizations from the regulating agencies. The above violations jointly, separately, or in any combination, had a direct or immediate relationship to the health, safety, or security of residents and staff.
