Inspector’s narrative

What the inspector wrote

Upon arrival at the facility at 10:00 AM to conduct an unannounced complaint inspection, Licensing Program Analyst (LPA) J. Sampair observed that no staff were wearing masks. LPA met with Licensee Donald Hay and reviewed SECTION IV of PIN 23-02-ASC dated February 9, 2023 and titled RESPIRATORS AND MASKING REQUIREMENTS IN ASC FACILITIES, which states: "Masks are required for individuals (other than residents) in indoor settings at ASC facilities, regardless of vaccination status, to continue to control the spread of COVID-19 pursuant to the State Public Health Officer Order (Beyond the Blueprint PHO) of October 13, 2022." Licensee acknowledged that he and his staff had not been following that COVID-19 guidance and promised to follow it moving forward. Facility cited for that deficiency as per Title 22 of the California Code of Regulations listed on the LIC9099-D. Failure to submit proof of correction (POC) by plan of correction due date and/or any repeat deficiencies within a 12-month period may result in civil penalties. Exit interview conducted. Appeal Rights and a copy of this report provided.
