Conformance with applicable laws and regulations

(d) The administrator shall have the qualifications specified in Sections 87405(d)(1) through (7). If the licensee is also the administrator, all requirements for an administrator shall apply. (2) Knowledge of and ability to conform to the applicable laws, rules and regulations. This requirement was not met as evidence by: the Administrator allowed residents to use a bedroom without obtaining a fire clearancel. This poses a potential safety risk to residents in care.

Annual routine visit with medical professional

Based on record review, the licensee did not comply with the section cited above for two out of four residents which poses a potential health risk to persons in care. LPA did not observe an annual assessment for or decline of statement for an assessment from Resident #1 and Resident #3.

Maintain fire clearance before retaining specified persons

Based on observation and record review, the licensee did not comply with the section cited above for one resident which poses an immediate safety risk to persons in care. During facility tour, LPA observed Resident #4 in bedroom #5. The fire inspection report and facility sketch on file with Community Care Licensing does not reflect a fifth bedroom.

Based on record review, the licensee did not comply with the section cited above for four out of four staff members (S2, S3, S4, S5) which poses a potential safety risk to persons in care. LPA Cloyd did not observe 20 hours of annual training for staff.

Maintain facility in clean, safe, sanitary condition

Based on LPA's observation, patio chairs are not in good repair. This poses a potential health, safety or personal rights risk to persons in care.

Requirement for building permit before construction

Based on LPA's observation and innterview, the licensee did not comply with the section cited above. There is an ongoing exterior painting job in the facility. The entire exterior of the home and walkways have been painted. This poses a potential health, safety or personal rights risk to persons in care.

Passageways and stairways kept clear

Based on LPA's observation and interview, the licensee did not comply with the section cited above. Passageways obstructions such a laundry bucket, hampers, laundry soap bucket, round table, cart, empty water and soda bottles in plastic bags, old mattress and other miscellaneous items were observed all around the outdoor passageways and stairways. This poses a potential health, safety or personal rights risk to persons in care.

Obtain required California clearance or exemption

Based on LPA's observation, record review and interview, Staff #1 is not associated to the facility according to LIS personnel summary records. Per administrator, staff #1 is working only as a trainee. This poses an immediate health, safety or personal rights risk to persons in care.

Store centrally held medications in locked secure place

Based on LPA's observation, the licensee did not comply with the section cited above. LPA observed and took photos of the following resident's medications: 2 bottles of generlac solutions, clearlax powder and metamucil on the kitchen counter. This poses a potential health, safety or personal rights risk to persons in care.
