Perform a pre-admission resident appraisal

Based on observation and record review, the licensee did not comply with the section cited above which poses an immediate health, safety or personal rights risk to persons in care. LPA did not observe a Preplacement Appraisal for R5. R5 was admitted to the facility on 9/21/25.

Dignity in personal relationships

87468.(a) Residents in all residential care facilities for the elderly shall have all of the following personal rights:(1) To be accorded dignity in their personal relationships with staff, residents, and other persons. This requirement was not met as evidence by LPA observed S1 yelling at R1. This poses a potential personal rights risk to persons in care.

Central store medicines that create safety hazards

Based on medication review, the licensee did not comply with the section cited above in two out of four resident's medications which poses an immediate health, safety and personal rights risk to persons in care. Resident's were taking medication without a doctor's order.

Include required health screening documents

Based on staff file review, the licensee did not comply with the section cited above in one out of three staff records, which poses an immediate health and safety risk to persons in care. A health screening report and negative TB test was unable to be provided.

Based on record review and Administrator interview, the licensee did not comply with the section cited above due to not conducting quarterly disaster drills, which poses a safety rights risk to persons in care.

87355 Criminal record Clearance(f) Violation of Section 87355(e) shall result in an immediate assessment of civil penalties of one hundred dollars ($100) per violation per day for a maximum of five (5) days by the department.(2) The Department may assess civil penalties for continued violations as permitted by Health and Safety Code Section 1569.49. This requirement is not being met as evidenced by the presence of Individual 1 (I1) in the facility August 9, 2023, November 7, 2023, witnessed by LPA Haley, and statements made by Licensee/Administrator Figueroa to Orange County Police August 9, 2023.

Certified administrator requirements and substitute coverage

Administrator-Qualifications and Duties87405(a):All facilities shall have a qualified and currently certified administrator...The administrator shall have sufficient freedom from other responsibilities and shall be on the premises a sufficient number of hours...This requirement is not met as evidenced by: Upon arrival to the facility, LPA Quiroz inquired about current AD Certification on premises. LPA Quiroz called and spoke to Licensee Noemi Figueroa who indicated "I tried taking the test but didn't pass it and AD Braulio Figueroa's hasn't renewed it since 2021." This poses a potential risk to residents in care.

Residents requiring skilled nursing or intermediate care; bedridden residents 1569.72(a)(f):(a) Except as otherwise provided...no resident shall be admitted or retained in a residential care facility for the elderly...Facility retaining a bedridden resident shall, within 48 hours of...CONTINUED BELOW R1diagnosis of bedridden the facility shall notify the local fire authority with jurisdiction in the bedridden resident's location of the estimated length of time the resident will retain his or her bedridden status in the facility. Maintain physician order documentation in resident record

Based on observation and interview, the licensee did not comply with the section cited above in 4 out of 4 residents as they had postural supports with no written physician's order which poses an immediate health, safety or personal rights risk to persons in care.

Prohibited Health Conditions: (a)Persons who require health services for or have a health condition including, but not limited to, those specified below shall not be admitted or retained in a residential care facility for the elderly: This requirement is not being met as evidenced by; On 3/8/2021, a visiting Home health Nurse assessed resident and observed 2 unstageable pressure injuries to the left and right heel. Administrator Noemi Figueroa did not contact department to obtain exception waiver and retained resident in the facility. This poses an immediate Health and Safety Risk to residents in care.

Regular observation and documentation of resident changes

Observations of the Residents: The licensee shall ensure that residents are regularly observed for changes in physical, mental, emotional and social functioning and that appropriate assistance is provided when such observation reveals unmet needs. When changes such as unusual weight gains or losses or deterriotion of mental ability or a physical health condition are observed, the licensee shall ensure that such changes are documented and brought to the attention of the resident's physician and the resident's responsible person, if any. This requirement is not met as evidenced by; on 3/4/2021, Administrator Noemi Figueroa and facility staff were aware of R1

Conformance with applicable laws and regulations

Administrator Qualifications and Duties: The administrator shall have the qualifications specified… Knowledge of and ability to conform to the applicable laws, rules and regulations. This requirement is not met as evidenced by; Administrator did not monitor R1’s change of condition, allowed an unqualified staff to treat unstageable wounds, and did not follow through with physician’s orders or obtain a higher level of care for R1. This poses an immediate Health and Safety Risk to residents in care.
