What the inspector wrote

Licensing Program Analyst (LPA) Ruth Martinez made an unannounced Case Management visit to the facility today in conjunction with a complaint investigation. LPA arrived at facility and was greeted by Yulisa Figueroa, Assistant Administrator and was granted entry. LPA explained the nature if the visit. This is to issue a citation today in conjunction with investigation to complaint number 22-AS-20210324133018. The Department observed additional deficiencies such as lack of Administrators knowledge of regulations as evidence by retention of a resident with prohibited health conditions. Administrator did not monitor R1’s change of condition, allowed an unqualified staff to treat unstageable wounds, and did not follow through with physician’s orders or obtain a higher level of care for R1. Based on this inspection, there were deficiencies observed in the facility in areas evaluated and are noted on the attached LIC 809-D forms. An exit interview was conducted and a copy of this report and appeals rights was provided to facility representative.

    Observations of the Residents: The licensee shall ensure that residents are regularly observed for changes in physical, mental, emotional and social functioning and that appropriate assistance is provided when such observation reveals unmet needs. When changes such as unusual weight gains or losses or deterriotion of mental ability or a physical health condition are observed, the licensee shall ensure that such changes are documented and brought to the attention of the resident's physician and the resident's responsible person, if any. This requirement is not met as evidenced by; on 3/4/2021, Administrator Noemi Figueroa and facility staff were aware of R1

    Prohibited Health Conditions: (a)Persons who require health services for or have a health condition including, but not limited to, those specified below shall not be admitted or retained in a residential care facility for the elderly: This requirement is not being met as evidenced by; On 3/8/2021, a visiting Home health Nurse assessed resident and observed 2 unstageable pressure injuries to the left and right heel. Administrator Noemi Figueroa did not contact department to obtain exception waiver and retained resident in the facility. This poses an immediate Health and Safety Risk to residents in care.

This poses an immediate Health and Safety Risk to residents in care.
