Licensing Program Analyst (LPA), Yolanda Delgado made an unannounced visit to the facility to investigate a complaint investigation into the allegation listed above. During the investigation, LPA conducted interviews and reviewed documents pertaining to the allegation. It was alleged staff sexually assaulted resident on the night of June 17, 2024, “inserted gauze into their rectal cavity 10 to 15 times”. Interviews with facility staff and Reporting party revealed R1 was hospitalized from June 16th through June 18, 2024. The LPA interviewed R1 and R1 denied that they were sexually assaulted while hospitalized. LPA also reviewed R1’s admitting documents and discharge documents from the hospital to corroborate the time frame of R1’s hospitalization and no facility staff could not have sexually assaulted R1 at the facility as R1 was hospitalized when the allegation was made. This agency has investigated the complaint alleging "staff sexually assaulted resident". We have found that the complaint was unfounded, meaning that the allegation was false, could not have happened and/or is without a reasonable basis.
