Prohibition on using other rooms as bedrooms

Maintain facility in clean, safe, sanitary condition

Based on LPA observations, the licensee did not comply with the section cited above as LPA observed a broken closet door in bedrrom 105, an exterior door hable in need of replacement and the exterior wood gate is barely haning on and is difficult to open in an emergency which poses/posed a potential health, safety or personal rights risk to persons in care.

Handle syringes and needles under bloodborne pathogen rules

Based on LPA observations and staff statements, the licensee did not comply with the section cited above as LPA observed an appropriate syringe disposal box without a lid and staff statements that syringes are disposed of in the municipal garbage bins which poses an immediate health, safety or personal rights risk to persons in care.

Additional Personal Rights of Residents in Privately Operated Facilities: To make choices concerning their daily lives in the facility. This requirement was not met as evidenced by LPA observations of staff member camouflaging medications in resident's hot chocolate without the resident's knowledge which poses an immediate health, safety and personal rights risk to residents in care.

Employees assisting residents with self-administration of medication; training requirements: To complete the training requirements set forth in this subdivision, each employee shall pass an examination that tests the employee's comprehension of, and competency in, the subjects listed in paragraph (3). This requirement was not met as evidenced by statements from S1 and file review for S1 that indicates S1 did not receive or pass a competency exam for medication administration which poses an immediate health, safety and personal rights risk to residents in care.

Obtain required California clearance or exemption

Criminal Record Clearance: Obtain a California clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by LPA review of staff files and individual associations and observed R1 (see LIC 811 dated 2/12/26) did not have their criminal record clearance associated to the facility which poses an immediate health, safety and personal rights risk to residents in care.

Conformance with applicable laws and regulations

Administrator - Qualifications and Duties: Knowledge of and ability to conform to the applicable laws, rules and regulations. This requirement was not met as evidenced by the number of violations observed and the nature of the violations has demonstrated to the department the administrator has not demonstrated an knowledge of or ability to conform to the applicable laws, rules and regulations which poses an immediate health, safety and personal rights risk to residents in care.

Incidental Medical and Dental Care: Assistance with self-administration does not include forcing a resident to take medication, hiding or camouflaging medications in other substances without the resident's knowledge and consent, or otherwise infringing upon a resident's right to refuse to take a medication. This requirement was not met as evidenced by LPA observations of staff members camouflaging medications in other substances as LPA observed open capsules of medications next to a cup of hot chocolate and residue of medications still visible in the cup. This was confirmed by S1 who administered the medications which poses an immediate health safety and personal rights risk to residents in care.

Store centrally held medications in locked secure place

Centrally stored medicines shall be kept in a safe and locked place that is not accessible to persons other than employees responsible for the supervision of the centrally stored medication. This requirement was not met as evidenced by LPA observations of a resident medication stored in a fridge without a lock box and accessible to residents in care which poses an immediate health, safety and personal rights risk to residents in care.

Obtain required California clearance or exemption

Criminal Record Clearance: All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working, residing or volunteering in a licensed facility...Obtain a California clearance or a criminal record exemption as required by the Department...this requirement was no met as evidenced by LPAs review of staff records and roster which indicated three individuals on the schedule or present at the facility that do not have a criminal record clearance or associated to the facility which poses an immediate health, safety and personal rights risk to residents in care.

Personal rights of residents in all facilities

Based on observation and interview resident bedroom 102 bathroom were observed locked. It was learned the bathroom is locked during the day and unlocked at night, this poses an potential health, safety or personal rights to resident in care.

Onsite food stock levels for nonperishables and perishables

Based on observation and facility inspection, the Licensee did not ensure that there were sufficient 2 days perishable food. This posed a immediate health and safety risk to residents in care.

Based on observation and interview the licensee did not comply with the section cited above. LPA and SS observed the facility pantry locked and was not accessible to resident in care, which poses an immediate health, safety, or personal rights risk to persons in care.

Living accommodations aligned with facility function

Based on observation and facility inspection LPA and SS observed residents’ room 101 was occupy by two facility staff which does not reflect the facility sketch and fire clearance. This posed a immediately health and safety risk to residents in care.

Prohibition on using other rooms as bedrooms

Based on interview, the licensee did not comply with the section cited above. It was learned that a staff sleeps on the roll out bed either in the activity room or the living room. The facility did not follow the facility sketch and fire clearance which poses an immediate health, safety or personal rights risk to persons in care.

Provide resident hot water for personal care

Based on observation and interview the licensee did not comply with the section cited above. Hot water temperature was measured at 130.1 degrees Fahrenheit in resident bathroom sink, which poses an immediate health, safety or personal rights risk to persons in care.

Submit and maintain current mailing address

Criminal Record Clearance: "(e) All individuals subject to a criminal record review pursuant to Health and Safety Code Section 1569.17(b) shall prior to working, residing or volunteering in a licensed facility:(1) Obtain a California clearance or a criminal record exemption as required by the Department..."This requirement was not met as evidenced by: Based on interviews and record review, E1 facilitated operations without a criminal record clearance, which poses an immediate health and safety risk.

Based on observation, the licensee did not comply with the section cited above, which poses an immediate health, safety or personal rights risk to persons in care.

Care of Persons with Dementia. Without violating Section 87468, Personal Rights, facility staff shall ensure the continued safety of residents if they wander away from the facility.This requirement is not met as evidence by: Based on reviewed records, the facility did not comply with section cited above. R1 AWOL'd from the facility and was found wandering in the community unsupervised by facility staff members. The LIC 602 states R1 was not allowed to leave the facility unassisted. This presents an immediate health and safety risk to the resident in care.
