Basic Service Requirements. Every facility required to be licensed under this chapter shall provide at least the following basic services: (e) Monitoring the activities of the residents while they are under the supervision of the facility to ensure their general health, safety, and well-being. This requirement is not met as evidenced by: Based on interviews and record reviews, R1 sustained multiple falls and injuries including a fracture due to lack of adequate supervision and did not timely implemented hospice's preventive recommendations. This poses an immediate health, safety and personal rights risk to residents in care.

Care and supervision as defined by statute and rules

Basic services shall at a minimum include: Care and supervision as defined in Section 87101(c)(3) and Health and Safety Code section 1569.2(c). This requirement was not met as evidenced by: Based on observation, interviews and record reviews, facility did not provide adequate supervision to R1. This poses an immediate health, safety and personal rights risk to residents in care.

1569.312 Basic services requirements (d)) Being aware of the resident's general whereabouts, although the resident may travel independently in the community. This requirement is not met as evidence by: Based on incident report, the facility did not comply with section cited above. R1 AWOL'D from facility without staff knowledge. The LIC 602 states the resident was not allowed to leave the facility unassisted. This poses an immediate health and safety risk to the resident in care.

Based on interview and record review the licensee did not comply with the section cited above. R5 did not have updated Physician's Report on file for review during this visit. Last Physician Report on file was completed on 7/21/20. This poses/posed a potential health, safety or personal rights risk to persons in care.

Report specified resident events within seven days

87211(a)(1) Reporting Requirements. Each licensee shall furnish to the licensing agency such reports as the Department may require. A written report shall be submitted to the licensing agency and to the person responsible…This requirement is not met as evidence by: Based on observations and records review, the licensee did not ensure to report incidents via a written report or verbal communication to community care licensing, which poses a potential health and safety risk to residents in care.

Personal assistance and care for required daily activities

87464 Basic Services (f) Basic services shall at a minimum...(4)Personal assistance and care as needed by the resident and as indicated in the pre-admission appraisal...This was not met as evidenced by: Based on interviews and record review, The licensee did not ensure services from the facility were provided to a resident as pertained to resident pre-appraisal conducted by the facility which poses an immediate health and safety risk of residents in care.

Right to sufficient care and qualified staff

87468.2 Additional Personal Rights of Residents in Privately Operated Facilities(a) In addition to the rights listed in Section 87468.1, Personal Rights of Residents in All Facilities, residents in privately operated residential care facilities...(4) To care, supervision, and services that meet their individual needs and are delivered by staff...This requirement was not met as evidenced by: Based on interviews and record review, The licensee did not ensure a resident had the appropriate measures to receive assistance when attempting to ambulate from a laying position which poses an immediate health and safety risk of residents in care.

Care of Persons with DementiaLicensees who accept and retain residents with dementia shall ensure that each resident with dementia has an annual medical assessment and a reappraisal done at least annually. LPA observed that R1 thru R4 diagnosed with dementia didn't have an updated LIC 602

Provide resident hot water for personal care

87303(e)(2) Maintenance and Operation -Faucets used by residents for personal care such as shaving and grooming shall deliver hot water. Hot water temperature controls shall be maintained to automatically regulate the temperature of hot water used by residents to attain a temperature of not less than 105 degree F (41 degree C)and not more than 120 degree F (49 degree C)-This requirement was not met as evidenced by observation: Hot water measured at 124.5*F in residents bathroom room 14 and 17.This poses an immediate health and safty risks to residents.

Maintain facilities for fire and panic safety

87203 Fire Safety. All facilities shall be maintained in conformity with the regulations adopted by the State Fire Marshal for the protection of life and property against fire and panic. This requirement is not met based on: Observation, The facility did not to maintained in conformity with the regulations adopted by the State Fire Marshal. The five years riser fire system inspection was outdated. The system was last serviced on 5/2017 and LPA was unable to locate the annual service sticker.
