What the inspector wrote

That previous investigation established that an ongoing legal dispute existed between the licensee and the property owner, including mediation efforts and a dismissed eviction. Based on the available evidence at that time, the January allegation was determined to be unsubstantiated. For the current complaint, the Department reviewed the prior investigative findings, conducted additional interviews with staff and verified the facility’s current operating status. The Department also reassessed documentation previously provided by the licensee and their legal counsel, which outlined that the licensee had purchased the business operation in June 2025 and maintained a valid lease agreement with the property owner; that an eviction notice issued by the landlord had been dismissed; that both parties had been and continued to be engaged in legal mediation; that a legal dispute remained pending regarding contractual responsibilities, city code issues, and lease terms; and that the licensee continued to operate the facility while simultaneously pursuing relocation, an application for which remained on file with the Department. The Department did not obtain any new information indicating that the licensee had lost legal authority to occupy or operate the facility. No new court actions, enforcement orders, or legal determinations were identified that would change the Department’s previous conclusion. Although rent related disputes between the licensee and property owner persisted, these matters remained civil issues outside the Department’s jurisdiction and did not demonstrate that the licensee lacked control of the property during the review period. Based on a review of the January evidence and the March investigative follow up, the Department finds there remains insufficient evidence to support the allegation that the licensee lost control of the property. An unsubstantiated finding means although violation may have occurred, there is not a preponderance of evidence to prove that the licensee lost control of property. Therefore, the complaint finding remains unsubstantiated, and no deficiencies are cited. An exit interview was conducted with HM Greene, and a copy of this report and Licensee Rights (LIC 9058) were provided
