What the inspector wrote

Licensing Program Analyst, Kelly Dulek arrived on November 4, 2025 for an unannounced inspection to follow up on a substantiated allegation of a complaint investigation. The LPA met with Administrator Sean Beharry. Licensee Michael Dimaguila arrived at 11:40AM. On January 20, 2023, the Department concluded a complaint investigation regarding the following allegation: Resident was physically assaulted by staff, resulting in bruising. The licensee was cited for California Code of Regulations (CCR) 87468.2(a)(4) Additional Personal Rights of Residents in Privately Operated Facilities. At the time of the complaint visit on January 20, 2023, an immediate civil penalty of $500 was issued. However, during a Non-Compliance Conference on May 21, 2025, the licensee was informed that additional civil penalties may apply. The Department has concluded an analysis and has determined that a civil penalty is warranted for physical abuse. The Welfare and Institutions Code Section 15610.63 for physical abuse means any of the following: Assault, as defined in Section 240 of the Penal Code; and Battery, as defined in Section 242 of the Penal Code. This is evidenced by the facility video footage showing the administrator physically abusing the resident by striking the resident and grabbing the resident by the hair, which resulted in the resident sustaining bruises. Today, November 4, 2025, the Department will be issuing a civil penalty per Health and Safety Code § 1569.49(f) for a violation that the Department determines constitutes as physical abuse in the amount of Report Continued on LIC 809-C $10,000. However, since an immediate civil penalty of $500 was previously issued on January 20, 2023, the amount of the civil penalty issued today will be $9,500. Exit interview conducted. A copy of the report issued. Appeal rights provided. Administrator Sean Beharry and signature on this report acknowledges receipt of the appeal rights, found on page two of LIC 421D.
