87608 Postural Supports (a) (5) Under no circumstances shall postural supports include tying, depriving, or limiting the use of a resident's hands or feet.This requirement is not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above as S1 tied/secured R1's feet to the wheelchair, which poses an immediate health, safety or personal rights risk to persons in care.

Safe, healthful, comfortable accommodations

87468.1 Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment. Based on interviews, the licensee did not comply with the section cited above as staff did not prevent R2 from entering R1's room and blocked R1's entry to their room, which poses an immediate health, safety or personal rights risk to persons in care.

Personal rights of residents in all facilities

87468.1 Personal Rights of Residents in All Facilities (a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (1) To be accorded dignity in their personal relationships with staff, residents... This requirement was not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above as, witnesses stated R1 was treated poorly by S1, which posed a potential health and safety risk to resident in care.

(a) Residents in all residential care facilities for the elderly shall have all of the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment.This requirement is not met as evidenced by: Based on the information obtained and reviewed, the Licensee did not comply with the section cited above as, staff failed to report faulty wheelchair brakes to hospice causing R1 to have an unwitnessed fall in the dining room, which posed a potential health and safety risk to resident in care.

(a)Each licensee shall furnish to the licensing agency reports…within seven days of the occurrence of any of the events specified in (A) through (D). (D)Any incident which threatens the welfare, safety or health of any resident. This requirement was not met as evidenced by: Based on record review, the licensee did not comply with the section cited above as, R1 had an unwitnessed fall causing a forehead bruise and right knee swelling which prompt hospice to have R1 placed on bed rest, which posed a potential health and safety risk to resident in care.

Care and supervision as defined by statute and rules

(f)Basic services shall at a minimum include: (1) Care and supervision as defined in Section 87101(c)(3) and Health and Safety Code section 1569.2(c).This requirement is not met as evidenced by: Based on the information obtained and reviewed, the Licensee did not comply with the section cited above as, R1 was left unsupervised resulting in R1 falling off their wheelchair and sustaining injuries, which posed an immediate health and safety risk to resident in care.

Report serious outbreaks and major accidents

87211 Reporting Requirements (a)(2) Occurrences, such as epidemic outbreaks, ...or major accidents which threaten the welfare, safety or health of residents...shall be reported within 24 hours either by telephone or facsimile to the licensing agencyThis requirement is not met as evidenced by: Based on interview and record review, the licensee did not comply with the section cited above, as R1 and R2 were diagnosed with suspected/presumed scabies, yet CCL and VCPH were not notified, which poses a potential health and personal rights risk to residents in care.

Assist residents with self-administered medication

Based on record review, the licensee did not comply with the section cited above as medication for R3 was not given 1/22/24 which poses an immediate health, safety or personal rights risk to persons in care.

Right to accept or decline care or services

87468.1(a)(16) Residents in all residential care facilities for the elderly shall have all of the following personal rights: To receive or reject medical care or other services. This requirement is not met as evidenced by: Based on interviews, the licensee did not allow R1 the personal right to reject the service of showers, as R1 and other residents are being forced to shower which posed a potential person right risk to residents in care.

Maintain separate complete record for each resident

87506(a) Resident Records. A separate, complete, and current record shall be maintained for each resident in the facility, readily available to facility staff and to licensing agency staff and shall contained specified information. Based on record review, the licensee did not have a complete and current record of shower refusals for R1 which poses a potential person right risk to residents in care.

Resident record must include minimum required items

Based on record review, the licensee did not comply with the section cited above in as LPA could not review admissions agreements, and 3 residents were missing SPV forms, 2 residents did not have signed resident rights forms which poses a potential health, safety or personal rights risk to persons in care.

Provide resident hot water for personal care

Based on observation, the licensee did not comply with the section cited above as the water temperature was measured between 124.0 degrees Fahrenheit and 127.5 degrees Fahrenheit which poses an immediate health, safety or personal rights risk to persons in care.

Based on record review, the licensee did not comply with the section cited above as one staff out of five staff was missing 20 hrs of annual training and three out of five staff were missing 15.5 hrs of annual training which poses/posed a potential health, safety or personal rights risk to persons in care.

Maintain facility in clean, safe, sanitary condition

Based on observation, the licensee did not comply with the section cited above as two rooms had furniture without knobs for residents to open their drawer which poses/posed a potential health, safety or personal rights risk to persons in care.

87755 Inspection Authority of the Licensing Agency (a) Any duly authorized officer, employee or agent of the licensing agency may...inspect the entire premise of any place providing services at any time, with or without advance notice. This requierment was not met by: Based on observation, the licensee did not comply with the section cited above, as the LPA was not granted access to two staff rooms due to staff not being present. Administrator did not have a copy of the keys which poses an immediate health and safety risk to residents in care.

87705(c)(5) Care of Persons with Dementia (c) Licensees who accept... residents with dementia shall.... ensuring the following: (5)Each resident with dementia shall have medical assessment and reappraisal,.. at least annually…This requirement is not met as evidenced by: Based on record review, the licensee did not comply with the section cited above asThe licensee failed to develop a care plan to meet R1’s needs and update the physicians report annually due to their diagnosis of dementia which posed a potential health and safety risk to residents in care.

Ensure hazardous items are locked and not unattended

87309(a)Disinfectants, cleaning solutions, knives, firearms and other items which could pose a danger if readily available to clients shall be stored where inaccessible to clients.This requirement is not met as evidenced by: Based on observation, the licensee did not comply with the section cited above as disinfectants, cleaning solutions, knives, medications were accessible to R1 in unlocked cabinets, drawers and shelfs on the 2nd floor which poses an immediate health and safety risk to residents in care.

Freedom to leave and not be locked in

87468.1(a)(6) Personal Rights of Residents in All Facilities (a) Residents ... shall have all of the followin....:(6) To leave or depart the facility at any time and to not be locked into any room, building, or on facility premises by day or night. This requirement is not met as evidenced by: Based on observation and interview, the licensee did not comply with the section cited above, as both stairwells doors to the 2nd floor are locked from the inside & outside, inhibiting R1 from going back to the 1st floor and exiting which poses an immediate personal rights risk to residents in care.

Report suspected non-serious physical abuse within 24 hours

87211(c) Reporting Requirements. Any suspected physical abuse that does not result in serious bodily injury... shall be reported to the local ombudsman, the licensing agency, and the local law enforcement agency within twenty-four (24) hours.This requirement is not met as evidenced by: Based on interviews, the licensee did not comply with the section cited above, as facility staff did not fulfill reporting requirements to appropriate parties, including Mandated Reporter requirements by reporting suspected abuse, which poses an immediate health and safety risk to residents in care.

87412(f) Personnel Records. All personnel records shall be available to the licensing agency to inspect, audit, and copy upon demand during normal business hours. This requirement was not met as evidenced by: Based on observation and interview, the licensee did not comply with the above cited section when S2’s personnel record was not available to CCL, which posed a potential health and safety risk to residents in care.

Maintenance shall include provision of maintenance services and procedures for the safety and well-being of residents, employees and visitors. This requirement was not met as evidenced: Based on observation and interview, the licensee did not comply with the above cited section when the facility was not clean and in good repair, which posed a potential health, safety, and personal rights risk to residents in care.

87211(a)(1)(D) Reporting Requirements. This requirement was not met as evidenced by: Based on interviews and record review, the licensee did not comply with the above cited section, when an incident report for 3 seperate incidents was not submitted to CCL, which posed a potential health and safety risk to residents in care.

Cool occupied rooms to regulated temperature range

87303 (b) A comfortable temperature for residents shall be maintained at all times.(2) The facility shall cool rooms to a comfortable range, between 78 degrees F (26 degrees C) and 85 degrees F (30 degrees C)...less than the outside temperature.This requirement is not met as evidenced by: Based on observation and interview, the temperatures inside the facility measured at 89 degrees Fahrenheit inside, which poses an immediate health, safety and personal rights risk to residents in care.
