From the field

What providers tell us about this citation

Based on community experience, not official guidance.

Thirty California RCFEs received citations for admitting or retaining totally dependent residents, with Ventura County alone accounting for 12. When a resident's care needs increase, LPAs review the most recent functional assessment against Section 87459 criteria. If you cannot document at least partial independence in some ADLs, the citation is immediate.

FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is the total dependence admission violation in California RCFEs?
This violation occurs when a California assisted living facility admits or retains a resident who depends on others to perform all activities of daily living. Title 22, Section 87615(a)(5) prohibits such admissions because RCFEs are not licensed to provide the level of care these residents require for their safety.
How common is this violation in California assisted living?
According to California CCLD inspection records, 30 California RCFEs were cited for admitting or retaining totally dependent residents, with 33 total citations issued across 7 counties. This is classified as a Type B violation. Ventura County led all regions with 12 citations, showing concentrated enforcement there.
What happens if an RCFE is cited for admitting a totally dependent resident?
The facility receives a Type B citation and must develop a plan of correction that includes relocating the resident to an appropriate care level. CCLD may require an immediate reassessment of all current residents. Type B citations carry civil penalties and remain on your public inspection record, visible to families and referral sources.
How do I fix or prevent total dependence admission violations?
Complete a thorough functional assessment using Section 87459 criteria before every admission. If a resident's condition declines to total dependence in all ADLs, start a transfer to a skilled nursing facility right away. Document every assessment and keep records current. Reassess residents quarterly and after any hospitalization to catch changes early.
Does admitting a totally dependent resident affect my RCFE license?
Yes. CCLD considers admission of residents beyond your licensed care level a serious compliance failure. While this is a Type B citation, repeated violations or failure to transfer an inappropriate resident can escalate to administrative action. Protect your license by verifying every admission against the functional capabilities defined in Section 87459.
