FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a Title 22, Section 87224(a) violation?
Title 22, Section 87224(a) requires California assisted living facilities to provide a specific, valid reason and a 30-day written notice before evicting a resident. Without proper documentation, the eviction is noncompliant. This rule protects residents from abrupt or unjust displacement.
How common is this violation in California assisted living?
According to public CCLD inspection records, 95 California RCFEs were cited for this issue. The state classifies these as Type B citations. Los Angeles and Sacramento are among the top counties where inspectors find incomplete discharge paperwork.
What happens if an RCFE is cited for improper eviction?
A facility cited under Section 87224(a) receives a Type B citation from the Community Care Licensing Division. The facility must correct the notice process and submit a plan of correction. Type B citations indicate a potential risk to residents if left uncorrected.
How do I fix or prevent an eviction notice citation?
Review your admission agreements to ensure they list the exact statutory grounds for eviction. Always serve a written 30-day notice detailing the specific reason. Keep a signed copy in the resident file to show licensing program analysts.
Does this violation affect my RCFE license?
Unresolved or repeated eviction issues create a pattern of noncompliance that the California CCLD tracks. The agency reviews these Type B citations during annual inspections. You must correct these documentation errors to maintain your facility license.
