FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a Title 22 Section 87465(a) violation?
It occurs when an assisted living facility fails to develop a plan for incidental medical and dental care. This required plan must outline exactly how staff help residents access routine healthcare. Without this framework in place, your residents may miss important medical appointments and face declining health.
How common is the incidental medical care plan violation in California assisted living?
According to public CCLD inspection records, 33 California RCFEs were cited for this deficiency. LPAs classify this as a Type A citation because of the direct risk to resident health. It appears most frequently in Los Angeles and Monterey counties, impacting a significant number of assisted living communities.
What happens if an RCFE is cited for missing a medical care plan?
Your facility receives a Type A citation, which demands an immediate plan of correction. Type A citations carry higher civil penalties than Type B citations. Your administrator must quickly create the required medical care plan and submit verifiable proof of compliance to the state to resolve the issue.
How do I fix or prevent an 87465(a) citation?
Draft a complete policy that explains how your staff arrange transportation and coordinate medical visits. Be sure to include a dedicated section on dental care access and preventative services. Update this plan annually, or whenever a resident's care needs change significantly, to ensure continuous compliance with Title 22 regulations.
Does a missing medical care plan affect my RCFE license?
Yes, a missing or inadequate medical care plan is a Type A violation that directly jeopardizes your license. California CCLD views the inability to coordinate medical care as a direct threat to residents. Repeated citations lead to mandatory follow-up inspections and potential restrictions on new admissions.
