FAQ

Frequently asked questions

Answers based on public CCLD data and regulation text. May not reflect recent changes.

What is a resident rights violation in a private RCFE?
This violation occurs when a privately operated assisted living facility fails to uphold the specific personal rights detailed in Title 22, Section 87468.2(a). These rights include managing personal finances, receiving unopened mail, and having private communications. Violating these rules compromises the dignity and autonomy of residents.
How common are resident rights violations in California assisted living?
According to California CCLD inspection records, 26 RCFEs were cited for infringing on these specific personal rights. These are typically classified as Type B citations. This means the violation creates a potential, rather than immediate, risk to residents. Alameda and Contra Costa counties saw the highest concentration of these citations.
What happens if an RCFE is cited for a resident rights violation?
The facility receives a Type B citation and must correct the practice immediately. While Type B citations carry lower civil penalties than Type A, they still require a formal plan of correction. Operators must document how they will prevent future rights violations and prove compliance during follow-up inspections.
How do I fix or prevent a resident rights violation?
Train all staff on the specific rights outlined in Section 87468.2(a) upon hire and annually. Regularly audit your practices regarding resident mail, phone access, and financial autonomy. Promptly address any resident complaints about privacy. LPAs often interview residents to verify their rights are respected during inspections.
Does a resident rights violation affect my RCFE license?
A single Type B citation will not automatically revoke your license, but it damages your public record. If CCLD identifies a pattern of rights violations, the agency may escalate enforcement actions. Protecting resident autonomy is a core licensing requirement for any California assisted living facility.
