BUILDINGS AND GROUNDS

(a) The child care center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors.This requirement was not met as evidenced by: LPA's observed missing glass tiles on the classroom ceiling, large stains on classroom rugs, broken handle, chipped paint and spider webs on the outdoor play structure and feces camouflaged by the large wood chips. Exposed tarp under the chips poses tripping hazard. This is a potential risk to the health and safety of children in care.

Each licensee... shall furnish to the Department reports as required by the Department including...: Upon the occurrence, during the operation of the child care center of any of the events specified in... below, a report shall be made to the Department by telephone or fax within the Department's next working day and during its normal business hours. In addition, a written report containing the information specified in... below shall be submitted to the Department within seven days following the occurrence of such event. Events reported shall include the following: Any injury to any child that requires medical treatmentThis requirement was not met as evidenced by: Facility failed to report to licensing an injury regarding day care child sustaining a fracture. This poses a potential risk to the health and safety of persons in care.

TEACHER-CHILD RATIO

101216.3 teacher-child Ratio (a)There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below. This requirement was not met as evidenced by: This requirement was not met as evidenced by: On at least one occasion facility was out of ratio when Director, who is the only staff with teacher qualifications assists a child to the restroom.

TEACHER QUALIFICATIONS AND DUTIES

101216.1 Teacher Qualifications and Duties(b) Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below:(1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing. This requirement was not met as evidenced by: Per interviews and record review, with the exception of Director none of the staff present meet the teacher qualification requirements which poses an immediate risk to the health and safety of children in care.

101216(i)(1)(2)(3) Prior to employment or initial presence in the child care center, all employees and volunteers subject to a criminal record review shall: (1)Obtain a California clearance or a criminal record exemption as required by law or Department regulations or (2)Request a transfer of a criminal record clearance as specified in Section... (3)Request and be approved for a transfer of a criminal record exemption, as specified in Section 101170.1(r)... This requirement was not met as evidenced by: One staff assisting with day care children was not associated to facility or have current clearance this poses an immediate health and safety risk to persons in care.

Childs Records. The licensee shall maintain, in each child’s record, a copy of the emergency information card required in Section 101221(a)(b)(5)... This requirement was not met as evidenced by record review: licensee did not have an emergency information card for 7 out of 14 children. This poses a potential Health and Safety Risk to children in care.

Based on [(observation) (interview), the licensee did not comply with the section cited above in that outdoor play area is not maintained LPA observed tears in the fence and missing parts to the play structure which poses/posed a potential health, safety or personal rights risk to persons in care.

SIGN IN AND SIGN OUT

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in that sign in/out sheets were not made available which poses a potential health, safety or personal rights risk to persons in care.

FOOD SERVICE

Based on [(observation), the licensee did not comply with the section cited above in LPA observed mold spots on a package of flour stored in the refrigerator which poses/posed a potential health, safety or personal rights risk to persons in care.

TEACHER-CHILD RATIO

Based on observation and record review, the facility did not comply with the section cited above in that 1 teacher and 2 teacher aids were supervising a total of 21 preschool children which poses an immediate health, safety or personal rights risk to persons in care.

Based on [(observation) (interview) (record review)], the licensee did not comply with the section cited above in that a Disaster and Mass Casualty Plan could not be made available during today's inspection which poses a potential health, safety or personal rights risk to persons in care.
