PARENTS RIGHTS. Upon presenting identification, the parent or authorized representative of a child in care has the right to enter and inspect the family child care home without advance notice during the family child care home's normal operating hours. OPERATION OF A FAMILY CHILD CARE HOME

(a)The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. This requirement was not met as evidenced by:Based on several interviews, the licensee is not present in the facility at least 80% of the time, and her assistants are caring for the children in care the majority of the time which poses a potential health and safety risk to children in care.

PERSONAL RIGHTS

(a)(1) To be treated with dignity in his/her personal relationship with staff and other persons. This requirement was not met as evidenced by: Based on interviews, the children in care feel the staff yell at them when they are being redirected which poses a potential health and safety risk to children in care.

(a)(2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment. This requirement was not met as evidenced by: Based on interviews, the preschool age children eat meals and snacks at times inside the garage which poses a potential health and safety risk to children in care.
