What the inspector wrote

Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Marie Lasker explained the purpose of the inspection. The director, 11 fingerprint-cleared and associated staff members, and 62 children in care were present for today's visit. Based of review of video footage provided during the course of investigation the Licensing Program Analyst (LPA) determined that there were instances in which the teacher momentarily left the children unsupervised. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, {Title 22, Division 12, Chapter 1, Section 101229 (1) is being cited on the attached LIC 9099D Appeal rights were given. A notice of site visit was posted and must remain posted for a period of 30 days. An exit interview was conducted with Director Marie Lasker.

    101229 Responsibility for Providing Care and Supervision (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above, which poses a potential risk to the health, safety, and personal rights of the children in care.
