What the inspector wrote

Licensing Program Analyst (LPA) Jyoti Saini arrived at the Facility unannounced to deliver the final findings. During the complaint investigation, the LPA reviewed records and CCTV footage and observed a staff member using a broom to clean the floor and simultaneously using the same broom to clean the children's snack table. This practice does not comply with the healthful accommodation regulations outlined in Title 22 Personal Rights 101223(a)(2). As a result, a Type B citation has been issued to the facility. Appeal rights were given. A notice of site visit was posted and must remain posted for a period of 30 days. An exit interview was conducted with Director Marie Lasker.

    101223 Personal Rights(a) The licensee shall ensure that each child is accorded the following personal rights:(3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning.This requirement is not met as evidenced by: Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above, which poses a potential risk to the health, safety, and personal rights of the children in care.

    101229 Responsibility for Providing Care and Supervision (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above, which poses a potential risk to the health, safety, and personal rights of the children in care.
