What the inspector wrote

On 06/07/2023 at 09:40 AM Licensing Program Analysts (LPAs) Lorraine Dacanay Breaux and Jaleesa Jackson met with Director, Nicole Custino for a sequent visit to investigate a complaint that was filed against the facility alleging "staff hit day care children". Facility is dual licensed and holds a license for infants (013421389). Present during the visit were thirty-eight (38) preschool age children and seven (7) additional staff. LPA interviewed director it was determined that the above allegation did indeed occur. As of April 24, 2023, facility terminated staff. LPAs determined the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22 is being cited on the attached LIC 9099D. Failure to submit Proof of Corrections (POC) by Plan of Correction date may result in civil penalties. Facility will notifiy current parents and new families up to 12 months from today's date. Parent's will be provided LIC9224 and the complaint within 24 hours for signature and returned to facility. A notice of site visit was given to director and must be posted for 30 days. Appeal Rights provided. Exit interview conducted and report was reviewed with Nicole Custino.

This requirement was not met as evidenced by: Staff inappropriately handled a child while in care. This poses a potential risk to the health and safety of the children in care.

    101170 - Criminal Record Clearance: (e) All individuals subject to a criminal record review shall prior to working, residing, or volunteering in a licensed facility; (1) Obtain a criminal record clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: LPAs observed a former staff did not have eligible clearance which is an immediate health, safety, and personal rights risk to children in care.

    101212(d)(1)(c)Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by: LPAs was informed by director that an incident was not report to child's parent(s) and Department of Social Services, which is an immediate health, safety, and personal rights risk to children in care.
