  101223 (a) (3)Personal Rights(a)The licensee shall ensure that each child is accorded the following personal rights(3)To be free from corporal or unusual punishment, infliction of pain, humiliation...mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. This requirement was not met as evidenced by: Staff inappropriately handled a child while in care. This poses a potential risk to the health and safety of the children in care.

  CRIMINAL RECORD CLEARANCE

  101170 - Criminal Record Clearance: (e) All individuals subject to a criminal record review shall prior to working, residing, or volunteering in a licensed facility; (1) Obtain a criminal record clearance or a criminal record exemption as required by the Department. This requirement was not met as evidenced by: LPAs observed a former staff did not have eligible clearance which is an immediate health, safety, and personal rights risk to children in care.

  101212(d)(1)(c)Events reported shall include the following: (C) Any unusual incident or child absence that threatens the physical or emotional health or safety of any child. This requirement was not met as evidenced by: LPAs was informed by director that an incident was not report to child's parent(s) and Department of Social Services, which is an immediate health, safety, and personal rights risk to children in care.
