Based on observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA observed Fire drill was last conducted on 9/11/24. Facility representative stated that the drill was done but not recorded .

ARTICLE 2. Administration of Child Day Care Licensing

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.This requirement is not met as evidenced by This requirement is not met as evidenced by:Based on observation and record review, the licensee did not comply with the section cited above in which poses a potential health, safety or personal rights risk to persons in care. LPA observed one staff members mandated reporter certificate expired on 6/17/24, and one staff member did not have mandated reporter certificate in file.

TEACHER-CHILD RATIO

(a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance...This requirement has not been met as evidenced by through record review and observation, the facility was operating with two unqualified staff with sixteen (16) children. This poses an immediate risk to the health and safety of the children in care.

1596.8595(b)(1) Notwithstanding subdivision (b) of Section 1596.859, the licensee shall post a licensing report...verifying the licensee’s... noncompliance with the department’s order to correct a deficiency ...This requirement was not met as evidenced by: LPA observed the report from the Non Compliance Conference she attended at the Oakland Regional Office on 2/23/2023 is not posted at the facility. This poses a potential risk to the health and safety of the children in care.

TEACHER QUALIFICATIONS AND DUTIES

(g) A photocopy of the teacher's Child Development Permit as specified in (c)(3) above, or a photocopy of the teacher's transcript(s) documenting successful completion of required course work, shall be maintained at the center. This requirement was not met as evidenced by, through record review it was found that one (1) teacher was missing a copy of a permit and/or transcripts. This poses a potential risk to the health and safety or the children in care.

1596.8595(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child...copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care... This requirement was not met as evidenced by through record review it was found that three (3) children are missing LIC9224 Acknowledgement of Receipt of Licensing Report. This poses a potential risk to the health and safety to the children in care.

1596.8595(d)(1) A licensed child day care facility shall provide to the parents or legal guardians...copies of any licensing document pertaining to a conference conducted by a local licensing agency management representative with the licensee in which issues of noncompliance are discussed. This requirement was not met as evidenced by through record review Licensee has not provided parents with the report or LIC9224 from the conference held on 2/23/2023 and.

(a) The licensee shall ensure that each child is accorded the following personal rights: (3) To be free from corporal or unusual punishment, infliction of pain, humiliation....This requirement was not met as evidenced by: Based on interview, it was discovered that a misbehaving child was excluded from a school field trip in order to prevent child from physically provoking other daycare children. This poses a potential risk to the health and safety to children in care.
