What the inspector wrote

On 3/01/2023 at 10:58am Licensing Program Analyst (LPA) Morgan Pringle arrived at the facility for an Unannounced Plan of Correction (POC) Inspection to follow up on deficiencies cited on an annual 1-year inspection conducted on 2/15/2023. LPA met with Licensee Deidra Daniels. Present during the inspection were two (2) staff members and (16) preschool age children Deficiencies cited on 2/15/2023 · 101170(e)(1) Criminal Record Clearance Deficiency was cleared on 2/17/2023 During the inspection LPA observed the following deficiencies as a result of todays POC inspection: 10:58am – Upon arrival LPA observed staff member Ashley Adams and Sandra Morando alone with (14) preschool children. Two (2) more children arrived later. 11:15am - LPA conducted a file review for both teachers. Both teachers do not have documentation on file to show they are qualified teachers and can be left alone with children. LPA observed Sandra alone in the classroom with (14) children at 11:15am and with sixteen (16) children at 12:03pm. LPA observed Ashley alone in the classroom with (15) children at 11:28am and with fourteen (14) children at 11:40am. 12:54pm - LPA Pringle observed the report from the Non Compliance Conference held on 2/23/2023 was not posted and no LIC9224 Acknowledgement of Receipt of Licensing Report forms were given to parents. 02:25pm - LPA conducted record review and found that there were three (3) unsigned Acknowledgement of Receipt of Licensing Report (LIC 9224) for the two (2) Type A citations that were received on 2/15/2023. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated. LPA Morgan Pringle informed licensee Deidra Daniels that this report dated 3/01/2023 document(s) one (1) Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Pringle informed the licensee to provide a copy of this licensing report dated 3/01/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with Director Deidra Daniels

  • TEACHER QUALIFICATIONS AND DUTIES

    (g) A photocopy of the teacher's Child Development Permit as specified in (c)(3) above, or a photocopy of the teacher's transcript(s) documenting successful completion of required course work, shall be maintained at the center. This requirement was not met as evidenced by, through record review it was found that one (1) teacher was missing a copy of a permit and/or transcripts. This poses a potential risk to the health and safety or the children in care.

  • TEACHER-CHILD RATIO

    (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance...This requirement has not been met as evidenced by through record review and observation, the facility was operating with two unqualified staff with sixteen (16) children. This poses an immediate risk to the health and safety of the children in care.

    1596.8595(b)(1) Notwithstanding subdivision (b) of Section 1596.859, the licensee shall post a licensing report...verifying the licensee’s... noncompliance with the department’s order to correct a deficiency ...This requirement was not met as evidenced by: LPA observed the report from the Non Compliance Conference she attended at the Oakland Regional Office on 2/23/2023 is not posted at the facility. This poses a potential risk to the health and safety of the children in care.

  • ARTICLE 2. Administration of Child Day Care Licensing

    1596.8595(c)(1) A licensed child day care facility shall provide to the parents or guardians of each child...copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care... This requirement was not met as evidenced by through record review it was found that three (3) children are missing LIC9224 Acknowledgement of Receipt of Licensing Report. This poses a potential risk to the health and safety to the children in care.

  • 1596.8595(d)(1)Type B

    1596.8595(d)(1) A licensed child day care facility shall provide to the parents or legal guardians...copies of any licensing document pertaining to a conference conducted by a local licensing agency management representative with the licensee in which issues of noncompliance are discussed. This requirement was not met as evidenced by through record review Licensee has not provided parents with the report or LIC9224 from the conference held on 2/23/2023 and.
