What the inspector wrote

These two children were observed throughout the video as being active and mobile within the classroom. At one point, the staff member hung children’s artwork on the classroom windows directly above C1’s cot but did not notice that C1 was experiencing a medical emergency. Since the staff member was busy hanging art supplies and supervising children that were awake and active within the classroom, they were not able to properly supervise all of the children including the child that experienced a medical emergency during naptime which concluded that the staff did not provide adequate supervision for children in care. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229 (a)(1) is being cited on the attached LIC 9099D A copy of this report and the LIC 9224 Acknowledgment of Receipt of Licensing Reports must be provided to the parents/guardians of currently enrolled children and all newly enrolled children for a period of 12 months following the date of this report. LIC 9224 must be signed within the next business day that children are in care and retained in each child’s file. Approval for an enhanced civil penalty is under review. Appeal rights were given. An exit interview was conducted, and the report was reviewed with Regional director, Eman Isbeih. A notice of site visit was posted and must remain posted for 30 days.

(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews, and record reviews, the Licensee did not comply with the section cited above, as of April 15, 2025, the lack of visual supervision resulted in a delayed response to a medical emergency, which poses an immediate risk to the health, safety, and personal rights of the children in care.

    101230 Activities (c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center.This requirement is not met as evidenced by: Based on interviews and record reviews, the Licensee did not comply with the section cited above. Staff member S1 was observed supervising a group of 14 children during the scheduled nap period. Out of the 14 children, two were awake and active, which placed the teacher out of ratio. This staffing arrangement poses a potential risk to the health, safety, and personal rights of the children in care.

(c) Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state.This requirement is not met as evidenced by: Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above, as discrepancies were identified in the children's records maintained at the facility, which poses a potential risk to the health, safety, and personal rights of the children in care.
