What the inspector wrote

Licensing Program Analyst (LPA) Jyoti Saini and Licensing Program Manager (LPM) Wynn Norona arrived unannounced to conduct a case management inspection regarding an Unusual Incident that was self-reported by the facility on 09/11/2025. Based on the incident self acknowledged by the facility and the interview conducted by the department, it has been determined that on September 10, 2025, a child was left in the classroom without adult supervision for approximately one minute, resulting in a violation of Title 22 regulations. As a result, California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101229 (a)(1), is cited on the attached LIC 809-D Appeal rights were provided. An exit interview was conducted, and the report was reviewed with Regional director, Eman Isbeih. A notice of site visit was posted and must remain posted for 30 days.

    101229 Responsibility for Providing Care and Supervision(a)The licensee shall provide care and supervision as necessary to meet the children's needs. (1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation.This requirement is not met as evidenced by: Based on interviews, and record reviews, the Licensee did not comply with the section cited above, as of April 15, 2025, the lack of visual supervision resulted in a delayed response to a medical emergency, which poses an immediate risk to the health, safety, and personal rights of the children in care.

    ACTIVITIES/NAPPING

    101230 Activities (c) A teacher-child ratio of one teacher supervising 24 napping children is permitted provided that the remaining teachers necessary to meet the overall ratio specified in Section 101216.3(a) are immediately available at the center.This requirement is not met as evidenced by: Based on interviews and record reviews, the Licensee did not comply with the section cited above. Staff member S1 was observed supervising a group of 14 children during the scheduled nap period. Out of the 14 children, two were awake and active, which placed the teacher out of ratio. This staffing arrangement poses a potential risk to the health, safety, and personal rights of the children in care.

    101206 Revocation or Suspension of License (a)The Department has the authority to suspend or revoke a license on any of the grounds specified in Health and Safety Code Section 1596.885. (c) Conduct which is inimical to the health, morals, welfare, or safety of either an individual in or receiving services from the facility or the people of this state.This requirement is not met as evidenced by: Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above, as discrepancies were identified in the children's records maintained at the facility, which poses a potential risk to the health, safety, and personal rights of the children in care.
