ADMISSION AGREEMENTS

The licensee shall comply with all terms and conditions set forth in the admission agreement. This requirement was not met as evidenced by:Based on record review, the center terminated a family which did not corrolate with the admission agreement which could pose a potential health and safety risk to children in care.

CHILD CARE CENTER DIRECTOR QUALIFICATIONS AND DUTIES

101215.1(b) Child Care Center Director Qualifications and Duties - All child care centers shall have a director.This requirement was not met as evidenced by: The facility does not have a qualified director. The individual assigned as the director needs to meet several requirements to qualify as a director.

PERSONNEL REQUIREMENTS

101216(g)(1) Personnel Requirements - Good physical health of all personnel shall be verified by a health screening, including a test for tuberculosis, performed by or under the supervision of a physician not more than one year prior to or seven days after employment. This requirement was not met as evidenced by:One staff member does not haved a Health Screening Report (LIC 503) nor proof of a TB clearance.

IMMUNIZATIONS

101220.1(g) Immunizations - The licensee shall document each child's immunization records and shall maintain such documentation in the center for as long as the child is enrolled.This requirement was not met as evidenced by: One child's file does not have any record of immunizations. 4 other children's immunization records need to be updated as it only provides proof of having received one of the three required doses of Hepatitis B vaccine.

CHILD'S RECORDS

101221(a) Child's Records - A separate, complete, and current record of each child shall be maintained at the child care center.This requirement was not met as evidenced by: Several children's files had incomplete documents and are need of being completed by the children's authorized representatives.

CHILD'S RECORDS

101221(b)(5) Child's Records - (b) Each record shall contain information including, (5) Name, address, and telephone number of the child's authorized representative and of relatives or others who can assume responsibility for the child is the authorized representative cannot be reached when necessary.This requirement was not met as evidenced by:One child does not have a Identification and Emergency (LIC 700) form in their file.

101221(b)(8) Child's Records - (b) Each record shall contain information including, (8) Medical assessments.This requirment was not met as evidenced by: Three children's files do not have a completed Physician's Report (LIC 701) form.

HEALTH-RELATED SERVICES

101226(e)(1)(B) Health Related Services - (e)(1) All prescription and non-prescription medications shall be centrally stored in accordance with (B) Each container shall have an unaltered label. This requirement was not met as evidenced by:One child's prescription medication did not include the original packaging nor the prescription label.

ARTICLE 1. General Provisions and Definitions

1596.7995(a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a child care center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccine between 08/01-12/01 of each year. This requirement was not met as evidenced by:One staff member does not have record of immunization against Measles (MMR). Two staff members do not have record for influenza.

REPORTING REQUIREMENTS

(f) The items specified in (d)(1)(A) through (H) above shall also be reported to the child's authorized representative. (B) Any injury to any child that requires medical treatment. This requirement was not met as evidenced by: A child sustained a injury while in care and the incident was not reported to the authorized representative. This poses an potential risk to the health and safety of children in care.

PERSONAL RIGHTS

101223(a)(2)The licensee shall ensure that each child is accorded the following personal rights:(2) To be accorded safe, healthful and comfortable accommodations...equipment to meet his/her needs. This requirement was not met as evidenced by: through admission during interview it was found that staff handled child in an inappropriate manner. This presents a potential risk to the health and safety to the children in care.

RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

101229(a) The licensee shall provide care and supervision as necessary to meet the children's need. This requirement was not met as evidenced by: The facility did not ensure proper care on completing a through wellness check on a child resulting in a child's needs being looked over, which poses a potential health, safety, or personal rights risk to children in care.

PERSONNEL RECORDS

101217 Personnel Records(a) The licensee shall ensure that personnel records are maintained on the licensee, administrator and each employee. Based on record review the facility files were found incomplete. This poses a potential health, safety and personal rights risk to persons in care.

101239(a)(1)(A)Fixtures, Furniture, Equipment and Supplies. The licensee shall maintain the temperature in rooms that children occupy between a minium of 68 degrees F(20 degrees C) and a maximum of 85 degrees F (30 degrees C) In areas of extreme heat, the maximum shall be 20 degrees F (11.1 degrees C) less than the outside temperature. Based on observation and interviews with facility representative the building heater is not working and has not in a few months, one classroom has a portable heater (nap room) for the children. This poses a potential health, safety and personal rights risk to persons in care.
