  RESPONSIBILITY FOR PROVIDING CARE AND SUPERVISION

  The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1). Supervision shall include visual observation. This requirement was not met as evidenced by: Based on interviews with facility staff on 04/28/23, it was corroborated that due to a lack of supervision, child C1 cut their hair with a pair of children's scissors found in the classroom; this was not observed by any staff member. This poses a potential health and safety risk to children in care.

  ARTICLE 2. Administration of Child Day Care Licensing

  A licensed child day care facility shall provide to the parents or guardians of each child receiving services in the facility copies of any licensing report that documents any Type A citation that represents an immediate risk to the health, safety, or personal rights of children in care as set forth in paragraph (1) of subdivision (a) of Section 1596.893b. The licensee shall require each recipient of the licensing report described in paragraph (1) to sign a statement indicating that he or she has received the document and the date it was received. This requirement was not met as evidenced by:Based on the LPA's interview with the center director on 04/28/23, the center director stated that the facility did not obtain signed LIC9224 “Acknowledgement of Receipt of Licensing Reports” from parents and guardians of each child receiving services in this facility. The facility was cited a Type A violation on 01/04/23. This poses a potential health and safety risk to children in care.
