What the inspector wrote

An unannounced case management inspection was conducted today at 2:16pm by Licensing Program Analyst (LPA), Tammy Dutra. LPA met with facility representative Shelly Tellez in response to an Unusual Incident Report received by the Department on 2/5/26. A child in care, (C1) was running up the stairs of the outdoor play structure and lost their footing falling on their face. C1 got a cut on their eye which resulted in medical care. The director, Shelly Tellez was interviewed on 3/10/26 at 2:45pm and stated that on 2/4/26 at 11:40am a child in care, C1 was playing outside and hit their face resulting in a laceration above their eye. Staff provided first aid while the child's representative was notified. C1's representative took C1 to receive medical care. Director stated the equipment was age appropriate and the facility operating was within their licensed capacity and ratio requirements. Director stated there were 14 children and 2 staff present during the incident. C1 was given stitches and returned to school three days later. One staff, (S1) was interviewed on 3/10/26 and stated that C1 was chasing a friend on the play structure and lost their footing causing them to fall and hit a stair on the corner of their eye. C1 began to cry and S1 immediately took the child inside for first aid. C1 received medical care and returned a few days later. S1 stated they were within ratio requirements. S1 said the injury may have been prevented if child was not running. One parent, (P1) was interviewed on 3/10/26 and stated that C1 had recovered after the injury. P1 had no concerns with regards to their child's care and supervision. P1 stated they were informed immediately and kept the child home for three days following the incident to ensure the stitches were kept clean and dry. P1 said C1 returned to the facility following the incident with normal behavior and no further issues. During today\342\200\231s inspection, the facility was toured and the playground equipment was observed. LPA observed age appropriate toys. Based on interviews, staffing/ ratio reviews and observation it was determined that the incident was an accident and no observable hazards were present on the playground. There were no deficiencies cited during today\342\200\231s inspection. Exit interview conducted and report was reviewed with the director Shelly Tellez. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
