What the inspector wrote

An unannounced case management inspection was conducted today at 11:10 am by Licensing Program Analyst (LPA), Laura Chavez. LPA met with licensee Angelica Rivera. The inspection was made in response to a self-reported Unusual Incident Report received by the Department on 4/16/2025, in which a child (C1) disclosed that another child (C2) inappropriately touched them and engaged with them sexually. During today's inspection LPA toured the home and observed the licensee and her assistant (A1) caring for 13 children inside the home. The licensee was interviewed on 7/10/2025 at 11:25am and stated that on 4/15/2025 at approximately 11:00pm, she received a call from a parent (P1) of C1 who reported that during C1\342\200\231s evening diaper change C1 disclosed they had been inappropriately touched and engaged sexually by C2 while they were in the converted garage used for daycare. Also, present were to additional children (C3-C4) who may have witnessed the incident at the time it occurred. The licensee stated she was inside the house, with another child (C5) preparing them and their personal items for the parent who would be arriving soon to pick them up. On 5/15/2025, at approximately 3:13pm, an interview was conducted with C1. On 7/2/2025, interviews were conducted with C2 and C3. Three out of 3 children interviewed made no disclosures related to the allegation. The incident in which C1 disclosed that C2 inappropriately touched them and engaged with them sexually was investigated by Investigations Branch (IB) Investigator Melissa Bennett. Given the statements and interviews provided, IB Investigator Bennett determined there is insufficient evidence to substantiate a lack of supervision and a personal rights violation. There were no deficiencies cited during today\342\200\231s inspection. An exit interview was conducted, and the report was reviewed with the licensee, Angelica Rivera. Appeal Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
