What the inspector wrote

Based on the interviews and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on 9099-D page for a Type A. 101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. (3) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse or other actions of a punitive nature including but not limited to: interference with functions of daily living including eating, sleeping or toileting; or withholding of shelter, clothing, medication or aids to physical functioning. (4) To be informed, and to have his/her authorized representative informed, by the licensee of the law regarding complaints including, but not limited to, information on confidentiality and the address and telephone number of the Department's complaint unit. Due to the issuance of a Type A Citation during today's inspection, a copy of this Licensing Report must be posted in the facility and given to each existing parent by the end of today or next day child is in care. Report also has to be provided to the parent of children who are enrolled over the next 12 months. In addition, a copy of the LIC 9224 Acknowledgement of Receipt of Licensing Reports must be signed by each parent and kept in each child's file. Licensee was informed that a Non Compliance Conference with CCLD Management will be scheduled at a later date. Exit interview was conducted with Ms Lily who authorized Ms. Anita to sign the report. Report, the deficiency, plan of correction, and appeal rights were discussed. A NOTICE OF SITE VISIT WAS ISSUED AND MUST BE POSTED ON OR ADJACENT TO THE INTERIOR SIDE OF THE MAIN DOOR INTO THE FACILITY FOR 30 CONSECUTIVE DAYS. (a) The licensee shall provide care and supervision as necessary to meet the children's needs.(1) No child(ren) shall be left without the supervision of a teacher at any time, except as specified in Sections 101216.2(e)(1) and 101230(c)(1).     101223(a) Personal Rights The licensee shall ensure that each child is accorded personal rights. his requirement is not met as evidenced by: Per LPA's investigations a child opened the bathroom door when another child was inside, resulting in that child being visually exposed to other children sitting at a table outside. Staff were not aware of the incident, did not visually witness it and became aware when children reported to them. Facility failed to provide safe, healthful and comfortable accommodations to children and which resulted in interference with toileting needs. THis is an immediate risk to safety of children.

This requirement is not met as evidenced by: Per LPAs investigation, on at least 2 occasions children used personal devices to interact with a stranger and physically exposed themselves. Staff were unaware, did not witness the incidents and made aware after children self-reported. This is an immediate risk to the health and safety of children.
