What the inspector wrote

On 12/22/2023 at 1:00 PM, Licensing Program Analyst (LPA) Christina Watts conducted a Case Management Inspection for Railroad Junction School. LPA met with Director, Lily Gupta and explained the purpose of today's inspection. During today's inspection, there were no school age children in care and no school staff present. All staff caring and supervising children have Criminal Record Clearance. LPA was conducting an investigation complaint against the facility. During the course of the investigation, it was determined that facility is using the incorrect rooms for the school age and preschool license. During inspection of facility plant, LPA observed the room for preschool program being for occupied school age program and the room for school age program being occupied by the preschool program. While LPA was conducting interviews for complaint, it was discovered that staff with no units has cared and supervising 4-6 school age children twice alone since employment. Also while conducting interviews, it was discovered that a school age child hit an preschool aged child during breakfast. These incidents are a violation of California Code of Regulation, Title 22. LPA Christina Watts informed Director, Lily Gupta that this report dated 12/22/2023 documents a Type B citation. Type B citation(s) are a potential risk(s) to the health, safety, or personal rights of children in care. *SEE LIC 809-D FOR DEFICIENCIES* Exit interview conducted and report was reviewed with the licensee, Director, Lily Gupta. A notice of site visit was given and must remain posted for 30 consecutive days.

    101223 Personal Rights (a) The licensee shall ensure that each child is accorded the following personal rights: To be free from corporal or unusual punishment or other actions of a punitive nature...This requirement has not been met as evidenced by: Based on interviews, the licensee did not comply with the section cited above when staff used inappropriate discipline practices with day care children which poses an potential risk to the health, safety or personal rights of children in care.

This requirement has not been met as evidenced by: Based on observation, interviews, record review, the licensee did not comply with the section cited above when facility is using incorrect rooms for license which poses an potential risk to the health, safety or personal rights of children in care.

This requirement has not been met as evidenced by: Based on interview, the licensee did not comply with the section cited above when staff spoke inappropiately to C1 which poses an potential risk to the health, safety or personal rights of children in care.
